Midvale Pedestrian Accident Lawyer

A lot of walking in Midvale is walking to transit. Three TRAX stations sit inside the city, Midvale Fort Union at 7250 South, Midvale Center on 7720 South and Bingham Junction on the west side, and the routes to them cross State Street (US-89), 7200 South (SR-48) and Fort Union Boulevard, wide roads built to move traffic between I-15 and the east side of the valley.

What stands out in UDOT's records for Midvale is how severe its pedestrian crashes have been. That changes the work on a claim: larger medical bills, a longer recovery to document, and a hard look at whether a driver who fled can be found or whether your own coverage has to carry the case.

Midvale's Pedestrian Crash Record

Between January 1, 2018 and August 4, 2025, UDOT's crash records place 70 pedestrian crashes within 250 feet of the 24 Midvale signals in its pedestrian and bicycle safety model, and 17 of them, 24.3%, ended in a death or a suspected serious injury. Among Utah cities with at least 20 pedestrian crashes at their signals, no city's share is higher. 7200 South and 300 West had 3 serious or fatal pedestrian crashes, the most at any signal in the city; 7200 South and State Street had the most pedestrian crashes overall, 9; and at 7800 South and Bingham Junction Boulevard, both pedestrian crashes were serious or fatal.

The records cut against two common assumptions. Of the 17 serious or fatal crashes, 9 happened in full daylight and 5 in the dark, so an argument about dark clothing does not fit most of the city's serious crashes. And 18 of the 70 pedestrian crashes were flagged as hit and run, 25.7%, against 17.6% statewide. Coverage When the Driver Stays, and When the Driver Leaves

Payment after a Midvale pedestrian crash usually comes from these layers:

  • PIP first. Personal injury protection pays a minimum of $3,000 toward medical expenses, plus lost income at 85% up to $250 a week, without anyone proving fault (§ 31A-22-307).   • Then the driver's liability policy. A claim for pain and other general damages against the driver opens once the injury satisfies § 31A-22-309(1)(a), for example a broken bone, more than $3,000 in medical expenses, or a permanent impairment shown by objective findings.

When the driver drove off, Utah treats an unidentified vehicle that left the scene of a crash it caused as uninsured (§ 31A-22-305(2)(b)), and that claim is not subject to the no-fault threshold (§ 31A-22-309(1)(b)). Fault, Mid-Block Crossings and the Clock

Utah cuts damages by your share of fault and allows recovery only if the others' combined share is greater than yours (§ 78B-5-818). On a wide road like State Street, an insurer may point to § 41-6a-1003, which requires anyone crossing outside a crosswalk to yield and, between adjacent signalized intersections, to use a marked crosswalk. Drivers carry their own duty to yield to pedestrians in a crosswalk (§ 41-6a-1002). Most suits allow four years, but where UTA, UDOT, Salt Lake County or Midvale City is responsible, a notice of claim is due within one year (§ 63G-7-402). See our statute of limitations page.

Where Midvale Pedestrians Are Hit

7200 South at State Street and at 300 West, the city's two highest pedestrian crash counts, where turning drivers cross heavy foot traffic. Fort Union Boulevard at 700 East, the one Midvale signal UDOT's model flags as unlit. Fort Union Boulevard at 900 East, which the model credits with the most people on foot, about 492 a day, and four nearby bus stops. Center Street at Main Street, second in estimated foot traffic at about 471 a day. Midvale Fort Union station, at 7250 South and 180 West, just south of the busy 7200 South corridor.

Midvale's police services come from the Unified Police Department, whose Midvale Precinct is at 7912 South Main Street and has two officers dedicated to traffic enforcement; UPD also fields a collision analysis and reconstruction unit. Unified Fire Authority crews respond from Station 125 at 655 West Center Street and Station 126 at 607 East 7200 South. Citations go to the Midvale Justice Court, 7505 South Holden Street, while an injury lawsuit belongs in the Third Judicial District Court, at the Matheson Courthouse in Salt Lake City or the West Jordan courthouse at 8080 South Redwood Road.

Pedestrians struck on a 40 mph arterial can suffer fractured legs and pelvis, traumatic brain injury, spinal injuries and internal bleeding. Intermountain Medical Center in Murray, just north of Midvale, is a Level I trauma center, and Alta View Hospital in Sandy is a Level IV center, according to the state's trauma center list.

Hit While Walking in Midvale: Common Questions

The driver who hit me drove away. Can I still recover?

Often, yes. Utah treats an unidentified vehicle that left the scene of a crash it caused as an uninsured motor vehicle, so your own uninsured motorist coverage can pay, and that claim does not have to meet the no-fault threshold. Report the crash to police promptly.

I crossed State Street away from a crosswalk. Is my claim over?

Not necessarily. Utah Code § 41-6a-1003 requires a pedestrian outside a crosswalk to yield, but the driver's speed, attention and lookout still count, and you can recover as long as your share of fault is less than the combined share of the others.

I was hit near a TRAX station by a UTA vehicle. Is there a special deadline?

Yes. UTA is a government entity, so a written notice of claim must be filed within one year under the Governmental Immunity Act, much sooner than the usual four-year limit.

Do I need my own car insurance to get PIP after being hit on foot?

No. Utah Code § 31A-22-308 extends PIP benefits under the policy on the vehicle involved to a pedestrian injured in Utah, so you may be covered even without a policy of your own.
