A few Utah rules shape almost every injury claim:
- Comparative fault (50% bar). Your compensation is reduced by your share of fault, and if you're found 50% or more responsible, you recover nothing. Insurers exploit this by shifting blame onto you.
- Statute of limitations. You generally have four years from the date of injury to file a personal injury claim in Utah — and only two years for a wrongful death claim. Miss the deadline and you can lose the right to recover.
- No-fault (PIP). Utah is a no-fault auto state: your own Personal Injury Protection pays initial medical bills regardless of fault, and you can pursue the at-fault driver once your medical costs exceed $3,000 or you suffer a permanent injury.
- What you can recover. Economic damages (medical bills, lost wages, future care), non-economic damages (pain and suffering, loss of enjoyment of life), and, in rare cases of egregious conduct, punitive damages.

What to Do After an Accident in Utah
- 1 Get medical care right away. Even if you feel okay — some injuries surface days later, and prompt treatment ties your injuries to the accident.
- 2 Report it. Call the police (or, for a fall or dog bite, notify the property owner or animal control) and make sure an official report is created.
- 3 Document everything. Photograph the scene, your injuries, and any hazard; get contact and insurance information and any witness details.
- 4 Don't talk to the insurance company. Never give a recorded statement or accept a quick settlement offer before speaking with an attorney.
