Utah Car Accident Laws You Should Know

Utah is a "no-fault" state. Every Utah auto policy includes Personal Injury Protection (PIP), which pays your initial medical bills and a portion of lost wages regardless of who caused the crash — up to your policy limits (a minimum of $3,000). You use your own PIP first.

When you can pursue the at-fault driver. No-fault has a threshold. If your medical expenses exceed $3,000, or you suffered a permanent injury, permanent disfigurement, or dismemberment, you can step outside the no-fault system and bring a claim against the driver who hurt you — for the full range of damages, including pain and suffering. (Utah Code § 31A-22-309.)

You have a deadline. In Utah, you generally have four years from the date of the crash to file a personal injury lawsuit, and two years for a wrongful death claim. Miss the deadline and you can lose the right to recover anything — which is why it's smart to talk to a lawyer early, while evidence is fresh.

Fault is shared on a sliding scale. Utah follows modified comparative negligence with a 50% bar. Your compensation is reduced by your share of fault — and if you're found 50% or more responsible, you recover nothing. Insurers know this rule and will try to pin as much blame on you as possible. Minimum coverage is often not enough — and why UM/UIM matters. Utah requires every driver to carry at least $30,000 per person / $65,000 per accident / $25,000 property damage. But a serious injury can easily cost far more than those limits — and some drivers on the road carry no insurance at all. That's why we strongly encourage carrying uninsured/underinsured motorist (UM/UIM) coverage on your own policy. If the driver who hurt you has no insurance, or not enough to cover your injuries, your UM/UIM coverage can step in and pay the difference. It's relatively inexpensive protection that can make all the difference after a serious crash — and it's one of the first things we check when reviewing your case.

Utah's roads are busier — and more dangerous — than many people realize. According to preliminary 2024 data from the Utah Department of Transportation (UDOT) and the Utah Department of Public Safety, 281 people were killed on Utah roads in 2024, up slightly from 279 the year before. Behind that number:

  • 78 were tied to speeding and speed management
  • 22 involved distracted driving
  • More than a third of those killed were not wearing a seat belt
