A Bedroom Community Wrapped Around State Highways

Roy is mostly neighborhoods, and its traffic rides on a handful of state routes. 1900 West (SR-126) runs north to south through the commercial core, 5600 South (SR-97) carries drivers east to I-15 and Hill Air Force Base, Riverdale Road (SR-26) angles northeast toward Ogden, and SR-108 serves the west side as 3500 West and Midland Drive. I-15 runs along the city's eastern edge, and FrontRunner and freight trains pass through town.

Because so much traffic uses so few roads, the risk concentrates. Base shift changes, school traffic and evening commuters pile onto the same arterials, and shopping-center driveways open straight onto them. UDOT's records show Roy's street crashes clustering in the late afternoon and at junctions where one driver crosses another's path.

Hill Air Force Base, Federal Drivers and Public Roads Change the Rules

A crash with a government vehicle, or one caused by a defective public road, follows its own procedure. A claim against Roy City, Weber County, UDOT or UTA requires a written notice of claim within one year (Utah Code § 63G-7-402), delivered to the office § 63G-7-401 names, such as the city clerk for a city, the county clerk for a county or the attorney general for the state, unless the entity has designated another agent. A collision with a federal employee on duty, including base personnel, may instead fall under the Federal Tort Claims Act and its own administrative claim process. Both run separately from the four-year limit on most injury suits.

Your Own Policy Pays the First Bills

Utah's no-fault system starts with personal injury protection from your own auto policy, regardless of who caused the crash. Utah Code § 31A-22-307 sets the floor at $3,000 in reasonable medical expenses, along with partial replacement of lost income. Our guide to Utah no-fault covers the details.

Roy City Fire & Rescue staffs three ambulances and a paramedic unit every day, and the closest Level II trauma centers on the Utah Bureau of EMS list are Ogden Regional Medical Center and McKay-Dee Hospital in Ogden. An ambulance ride plus imaging can consume the PIP minimum in one visit, and PIP never pays for pain or lost quality of life.

Claiming those general damages from the at-fault driver requires an injury that meets at least one condition of § 31A-22-309(1):

  • Medical bills totaling more than $3,000
  • A fracture of any bone
  • Permanent impairment or disability supported by objective medical findings
  • Disfigurement that will not go away
  • Dismemberment, or a death

With the threshold met, the at-fault driver's liability carrier is answerable for the full loss, limited only by its coverage. A driver who carries just the minimum, $30,000 per person on policies issued or renewed on or after January 1, 2025 (§ 31A-22-304), may not have enough, so underinsured motorist coverage on your own policy often decides how much is actually collectible.

How Utah Divides Fault Between Drivers

Under Utah Code § 78B-5-818, a person can recover only from defendants whose fault, taken together, exceeds his or her own, and the award drops by that person's percentage. If the fact finder calls it even, the injured person recovers nothing.

In Roy, fault disputes tend to center on junctions. A left turn across 1900 West, a driver pulling out of a shopping-center exit, a young driver misjudging a gap on 3500 West: each one turns on what the signal showed, who reached the intersection first and how fast everyone was moving. Signal timing data, phone records and where the vehicles came to rest usually answer those questions.

What to Do After an Injury in Roy

  • Report it. Call 911 so Roy City Police, based at 5051 South 1900 West, or the Utah Highway Patrol on I-15 can document what happened, and keep the case number.   • Photograph the vehicles, the intersection, the signals, the road surface and your visible injuries, and keep photographing the injuries as they change.
  • Get names and numbers from witnesses. FrontRunner riders, shoppers and passing commuters rarely return to the scene.
  • Start a PIP claim with your own insurer, and decline a recorded statement to the other driver's company until you know how badly you are hurt.
