Your Right-of-Way on Foot

A driver must slow down or stop for a pedestrian in a crosswalk on the driver's half of the road, or one approaching so closely from the other half as to be in danger; must come to a full stop at an occupied school crosswalk; and may not pass a vehicle stopped to let someone cross (Utah Code § 41-6a-1002). At an intersection, the crosswalk is the space between the sidewalk lines even where nothing is painted (§ 41-6a-102).

Away from an intersection crosswalk the duty flips: the pedestrian must yield, and between two signalized intersections a person may cross only in a marked crosswalk (§ 41-6a-1003). Which Insurance Pays

Several policies can be in play after a Murray pedestrian crash:

An injury suit generally has four years, but a crash involving a UTA bus or train, a Murray City vehicle or a dangerous public road needs a notice of claim within one year (§ 63G-7-402). I crossed at a corner with no painted lines. Was I in a crosswalk?

Usually yes. Utah Code § 41-6a-102 treats the area between the sidewalk lines at an intersection as a crosswalk whether or not it is painted, and drivers must yield to a pedestrian in it.

I crossed State Street mid-block. Can I still recover?

Possibly. Outside a crosswalk a pedestrian must yield, but a driver who was speeding or distracted can still carry most of the fault, and your recovery is reduced by your share unless that share reaches 50%.

The crash happened near a TRAX station. Does that change anything?

If a UTA train, bus or employee was involved, the claim is against a government entity and a written notice of claim is due within one year. If only a private driver was involved, the usual four-year limit applies.

Will my own car insurance help even though I was walking?
