Provo Slip and Fall Lawyer

Hurt in a fall on a Provo sidewalk, apartment stairway, store floor or campus walk? The person who controlled that property may owe you for it. Free consultation, and no attorney fees unless we win.

Provo packs a large student population into rental housing near BYU and downtown, and that shapes its fall cases. Exterior stairs and balconies at older complexes, shared walkways no one feels responsible for, and parking areas that refreeze after dark come up again and again, alongside the usual spills in retail aisles.

Provo City expects residents to clear snow from their sidewalks, driveways and mailboxes within 24 hours after a storm (City Code Title 9.16). That is a city enforcement rule and does not by itself settle who pays for a fall, but it gives a concrete yardstick when a landlord or business let a walk sit icy for days.

Proving a Provo Fall Claim

A fall rarely produces a police report the way a car crash does. What carries the claim is proof that a hazard existed, that the owner, landlord or manager knew about it or would have found it with reasonable inspection, and that it is what brought you down.

In rental housing the lease matters: it often says who handles snow, lighting and repairs, and an earlier text or email to the property manager about a broken step can show they were on notice. At a store, ask for an incident report, keep the shoes you wore, and ask in writing that camera footage be saved before it is recorded over.

The Duty Owners Owe in Utah

What an owner had to do depends on your reason for being on the property:

  • Customers and tenants invited in for business get the fullest protection: the owner must inspect for hazards and repair them or warn about them.
  • Guests at a private home must be warned about dangers the host already knows of.
  • People with no permission to be there are owed much less.

A landlord or store will often say the hazard was plain to see. That argument can lower a recovery, but a visible hazard is not automatically a defense when the owner should have expected people to walk through it anyway.

Your share of fault. Utah's comparative negligence law, § 78B-5-818, lets you recover only if the defendants' combined fault exceeds yours, and it trims the award by your percentage. Adjusters in Provo cases like to ask about footwear, backpacks and phones.

Filing deadlines. Most injury suits carry a four-year limit. A fall on a city sidewalk, in a Provo City building or on other government property needs a written notice of claim within one year (§ 63G-7-402). BYU is a private university, so a fall on its campus is a claim against a private owner. Our statute of limitations page lists every deadline.

Where Provo Falls Happen

Student apartments north and east of BYU, where exterior stairs, icy landings and dim parking areas are common, and where the owner, a management company and sometimes a snow contractor each point at the other.

Downtown along Center Street and University Avenue, where older storefront entrances, curb cuts and sidewalks carry restaurant and event crowds, and Provo Towne Centre, where wet entrances, food-court spills and parking-lot ice are the usual questions.

Public property such as city sidewalks and parks and the UTA platforms at Provo Central station, where a government owner brings the one-year notice into play. If a vehicle was involved, our Provo car accident page covers that side, and our Provo personal injury page covers the rest.

Hazards We See in Provo

Stairs with a loose or missing handrail, balconies and landings that freeze, walkways heaved by tree roots, freshly mopped floors with no sign, broken asphalt in parking lots, and burned-out lights in stairwells and garages.

How Falls Injure People

Wrist and ankle fractures from bracing against the ground, hip fractures in older adults, concussions from striking concrete, and back injuries are common. Serious injuries in Provo are often treated at Utah Valley Hospital, a Level II trauma center.

Damages in a Fall Case

  • Financial losses: hospital and therapy bills, future care, missed work and a reduced ability to earn.
  • Human losses: pain, anxiety, lost sleep and time taken away from school, sports or family life.
  • Lasting harm: the cost of care and adaptation when an injury never fully heals.

What the Other Side Will Argue

Expect the owner's insurer to say you should have watched your step, that the spill was brand new, or that the tenant rather than the landlord was supposed to salt. Photos, dated messages to management, weather data and snow-removal records answer those points. If a case has to be filed, it goes to the Fourth Judicial District Court at 137 North Freedom Boulevard in Provo. Our Utah slip and fall guide explains the proof, and the steps in a Utah injury case show what follows.

Common Questions

Provo Fall Questions

I fell on an icy stairway at my Provo apartment. Who is responsible?

Often the landlord or management company, but the lease and any snow-removal contract matter. Complaints you sent in writing before the fall can help show they knew about the problem.

Is a fall on the BYU campus handled differently?

BYU is a private university, so the one-year government notice rule does not apply there. The claim is evaluated like one against any private property owner.

Does it matter if I was partly careless?

Your recovery is reduced by your share of fault, and you recover nothing unless the defendants' combined fault is greater than yours, under Utah Code § 78B-5-818.

How much does it cost to hire you?

You pay nothing up front, and no attorney fees unless we win. Our fee comes out of the recovery, and the written agreement explains how case costs are handled.

I tripped on a broken city sidewalk. What is the deadline?

A written notice of claim must reach the city within one year. Missing it can end the claim, even though most other injury suits allow four years.

What should I do first after a fall?

See a doctor, tell the manager or landlord in writing, photograph the spot and your shoes, and keep the names of anyone who saw it happen.
