Magna Pedestrian Accident Lawyer

Magna’s state highways were built to move traffic in and out of the west end of the valley, and people on foot share them anyway. They walk to UTA Route 35 stops on 3500 South, cross 8400 West to reach homes and shops, and head downtown to Magna Main Street. Magna has been a city since May 2024, governed by a mayor and five council members, and it contracts with the Unified Police Department for law enforcement and with the Greater Salt Lake Municipal Services District for other municipal work.

Where you were walking shapes almost everything about a Magna pedestrian claim: which traffic rules applied, who owns the road, what evidence exists, and how far the ambulance had to drive. The sections below take the common places one at a time.

On the Shoulder of 8400 West

According to our Magna most dangerous roads study of UDOT records, 8400 West (SR-111) had 459 crashes from January 2018 through August 4, 2025, 14 of them serious or fatal, and pedestrians were involved in 4 of the serious ones. Its busiest junctions were 3500 South (76) and 3100 South (59, 4 serious or fatal). Where a road has no sidewalk, Utah sends pedestrians to the shoulder, as far from the travel lanes as practicable; with no shoulder either, they keep near the outside edge and, on a two-way road, walk on the left facing traffic (§ 41-6a-1009). Someone who did that was exactly where the law told them to be.

Crossing a highway like this one brings in two more sections. Outside a marked crosswalk or an unmarked crosswalk at an intersection, the person on foot gives way to vehicles, and between two adjacent intersections with working signals, crossing is allowed only in a marked crosswalk (§ 41-6a-1003). Once inside a crosswalk, the burden reverses: a driver has to yield, stopping if necessary, whenever the walker is in the driver’s half of the roadway or near enough from the other half to be in danger (§ 41-6a-1002). At the Bus Stop on 3500 South

3500 South (SR-171) links Magna with West Valley City and is the route of UTA’s 3500 South bus, Route 35, which serves Magna. Our study recorded 382 crashes on it over the same period, 6 serious or fatal, with hit and run flagged in 57 (14.9%). For someone hurt on foot there, coverage tends to stack up in layers:

  • PIP first. If you, or a relative you live with, has an auto policy, its personal injury protection covers you when any motor vehicle hits you; if no one in the household is insured, the striking car’s PIP extends to a pedestrian hurt in Utah (§ 31A-22-308). Fault does not matter for this layer, which pays at least $3,000 in medical expenses plus a portion of lost income (§ 31A-22-307); see how Utah no-fault works.
  • Then the driver. You can pursue general damages such as pain and suffering against the at-fault driver once your injury satisfies a threshold in § 31A-22-309, such as a bone fracture, objectively proven permanent impairment, permanent disfigurement, or medical expenses above $3,000.

Then your own policy again. When the driver fled or carried no insurance, uninsured motorist coverage applies, and an unidentified driver who left the scene counts as uninsured (§ 31A-22-305); when the driver’s limits are too low, underinsured motorist coverage may add to them. Across Magna, hit and run appeared in 17.5% of all crashes from January 2018 through August 4, 2025, second only to Kearns among the cities in our study. Downtown on Magna Main Street

Magna Main Street (2700 South) moves slower, and its numbers show it: 120 crashes in the study period and none serious or fatal, though half were angle crashes and 38 happened at 8400 West. Low speed does not make an impact harmless to someone on foot, and downtown cases often involve a driver backing out of an angled space or turning through a crosswalk without looking. Utah lowers a pedestrian’s damages by any percentage of fault assigned to them and bars recovery at 50% or more (§ 78B-5-818), so a backing driver’s claim that you walked behind the car needs an answer from video or witnesses.

Near Schools and on Neighborhood Streets

Cyprus High School, at 8575 West Cordero Drive, puts new drivers and students on foot on the same streets at the start and end of each school day. Teen drivers show up in the crash data as well: on 3100 South, a teen driver was involved in 58 of its 182 crashes during the study period. When a school crosswalk is occupied, Utah requires drivers to come to a complete stop rather than merely slow (§ 41-6a-1002(2)).

The Unified Police Department’s Magna Precinct, 2711 South Buccaneer Drive, patrols both Magna and Copperton and responds to crashes in town; the Utah Highway Patrol may take a crash on SR-201. Unified Fire Authority crews respond from Station 102 at 8609 West Magna Main Street and Station 111 at 8215 West 3500 South. Any traffic ticket written to the driver is handled by the Salt Lake County Justice Court, whose jurisdiction covers Magna, while an injury lawsuit belongs in the Third Judicial District Court, at the Matheson Courthouse in Salt Lake City or the West Jordan courthouse on Redwood Road. Deadlines in Magna Cases

The usual limit for an injury lawsuit is four years (§ 78B-2-307), and a wrongful death action has two (§ 78B-2-304). Because 8400 West, 3500 South and SR-201 are state highways, the signals and crossings along them belong to UDOT, and a claim against UDOT, Magna City, Salt Lake County or UTA requires a written notice of claim within one year (§ 63G-7-402). Getting to a Hospital From Magna

Magna has no hospital inside the city, and the nearest emergency rooms are in West Valley City and West Jordan. Holy Cross Hospital – West Valley, 3460 South 4155 West, holds a Level III designation on the Utah Bureau of EMS trauma list, while Intermountain Medical Center and University Hospital are the Level I centers serving the valley. Highway-speed impacts commonly leave pedestrians with fractured legs and pelvis, traumatic brain injury and spinal damage.

Magna Pedestrian Accident Questions

I was walking on the shoulder of 8400 West when a car hit me. Was I where I should be?

If there was no sidewalk, yes. Utah Code § 41-6a-1009 directs pedestrians to the shoulder where no sidewalk is provided, and drivers still owe reasonable care to anyone using it.

A driver backed out of a Main Street parking space into me. Who pays?

Usually the driver’s liability insurer, after your own PIP covers early medical bills. A driver backing out owes the same care to people behind the car as to anyone else, and video from nearby businesses often settles what happened.

I crossed 3500 South away from a crosswalk to catch the bus. Do I have a case?

You may. Crossing mid-block meant you had to yield, but fault is shared in Utah, and a driver going too fast for conditions may be assigned the larger part. Your recovery is reduced by your percentage and lost only at 50% or more.

Is there a hospital in Magna?

No. The nearest emergency rooms are in West Valley City and West Jordan. Holy Cross Hospital – West Valley is a Level III trauma center, and the most serious injuries may be taken to a Level I center.
