Layton Roads Where Trucks Cause Serious Crashes

Layton is where through freight on I-15, deliveries to Davis County's busiest retail district and supply traffic bound for Hill Air Force Base all converge. A truck crash here usually happens on one of five routes, and the route tells us early which records and which defendants matter.

I-15 at the Layton interchanges

Long-haul tractor-trailers running between Salt Lake and Ogden pass commuters who are merging on and off at Layton's exits. A driver near the end of a long shift who misjudges a slowdown at a ramp is a common story, which is why the driver's logs are among the first things we ask for.

Hill Field Road (SR-232) to the south gate

SR-232 connects I-15 Exit 331 with Hill AFB's south gate. Contractor trucks and freight headed for the base share the road with shift-change traffic that stacks up at the gate, so a heavy vehicle that fails to stop for a queue can push several cars together.

US-89 on the east bench

Rebuilt by UDOT as a freeway-style route with interchanges at Antelope Drive, Gordon Avenue and Oak Hills Drive, US-89 now carries gravel haulers and through trucks at highway speed beside the foothills. Ramp merges with a loaded truck in the right lane are where these crashes start.

Antelope Drive retail corridor

Semi-trailers deliver to the stores and restaurants packed along Antelope Drive, turning wide into loading lanes behind the buildings. Cars that slip into the gap on the right side of a turning trailer, and pedestrians crossing driveways, are the ones who get hurt.

Around the Layton FrontRunner station

Streets feeding the station mix commuters parking for the train with delivery vans and service trucks. Low-speed impacts with backing trucks and turning vans are typical, and nearby business cameras are often the best evidence.

Police, the base and the one-year notice

Layton City Police investigate crashes on city streets and the Utah Highway Patrol covers I-15 and US-89. A crash on Hill AFB, or with a federal employee driving on duty, may fall under the Federal Tort Claims Act, which starts with an administrative claim to the agency. If UDOT, UTA or a city truck was involved, Utah Code § 63G-7-402 bars the claim unless a notice is filed within one year.

Paying Medical Bills After a Layton Truck Crash

Utah's no-fault system sends your first medical bills to your own car policy, even when a commercial driver was clearly at fault. Personal injury protection under Utah Code § 31A-22-307 provides at least $3,000 for treatment and pays the lesser of $250 a week or 85% of lost gross income, for up to 52 weeks. More detail: Is Utah a no-fault state?

An ambulance ride and imaging at Holy Cross Hospital – Davis can use up that amount on the first day. Before you can seek pain and suffering from the trucking company, Utah Code § 31A-22-309 requires at least one of the following:

  • Over $3,000 in medical expenses.
  • A broken bone.
  • A permanent disability or impairment based on objective findings.
  • A permanent disfigurement.
  • A dismemberment.
  • A death.

Once any of these applies, the carrier's liability policy answers for the full claim, including future care and lost earning power. A local contractor's truck may carry much less coverage than an interstate carrier, and your underinsured motorist coverage can add to a policy that runs out. An uninsured motorist claim does not need the threshold. See how UIM coverage works in Utah.

Dividing Fault in a Layton Truck Case

Utah Code § 78B-5-818 allows recovery only from defendants whose combined fault is greater than yours, and your own percentage is deducted. At 50% or more, you recover nothing.

Adjusters for trucking companies often argue that a car stopped suddenly in front of the truck in the Hill Field Road queue, merged too tightly onto US-89, or passed a turning trailer on the right on Antelope Drive. The truck's electronic logging data, its engine data and gate or storefront video can answer those claims, but only if someone asks for them in time.

Filing deadlines

Four years for most vehicle-injury lawsuits (§ 78B-2-307), two years for a wrongful death action (§ 78B-2-304), one year for a notice of claim against UDOT, UTA, Davis County or Layton City, and separate federal timelines if the base or a federal driver is involved. Our deadlines guide covers the rest.

Hours-of-Service Rules and Driver Fatigue

The daily driving limits

A property-carrying driver must start with 10 consecutive hours off duty, may drive up to 11 hours, cannot drive after the 14th hour since coming on duty, and needs a 30-minute break once 8 hours of driving have passed (49 CFR 395.3(a)). Weekly caps of 60 hours in 7 days or 70 in 8 apply on top of that (49 CFR 395.3(b)).

The electronic logging device

Most carriers must install an ELD and require drivers to record duty status with it (49 CFR 395.8(a)). Compared against fuel receipts, gate records and dispatch messages, the log can show a driver who was already past the limit when the crash happened.

Driving while too tired

Apart from the hour limits, no driver may operate, and no carrier may require or permit a driver to operate, while fatigue or illness has made driving unsafe (49 CFR 392.3). A carrier that schedules runs no one could complete legally shares that responsibility.

Local runs and the short-haul exemption

Drivers who stay within a 150 air-mile radius and are released within 14 hours can be exempt from the logbook rule, but the carrier must keep accurate time records for six months (49 CFR 395.1(e)(1)). Regional haulers and base contractors often rely on this exemption, so their time records become the evidence. Our Utah truck accident guide explains who else can share fault.

A truck that drove away

If a truck forced you off I-15 or US-89 and never stopped, your uninsured motorist coverage may pay. If it never touched you, Utah Code § 31A-22-305(6) requires clear and convincing proof beyond your own testimony that it existed, so write down any company name or trailer number you saw.

What to Do After a Layton Truck Collision

  • Call 911 and stay until Layton Police, UHP or base police arrive. Note the agency name and case number.
  • Get medical care the same day. Holy Cross Hospital – Davis in Layton is a Level III trauma center, and the most serious injuries may go to McKay-Dee Hospital in Ogden, a Level II center.
  • Photograph both sides of the cab for the carrier name and USDOT number, the trailer plate, the load and the lanes.
  • Ask other drivers and anyone who stopped for names and phone numbers.
  • Open your PIP claim with your own insurer, and let a lawyer handle the carrier's adjuster before any recorded statement.

A Layton truck lawsuit is filed in the Second Judicial District Court at 800 West State Street in Farmington. Most claims resolve without trial, but the carrier should receive a written demand to preserve its logs and engine data within days. Call (801) 921-5134 or request a free case review.
