Orem Truck Accident Lawyer

Injured in a crash with a tractor-trailer or commercial truck in Orem? Talk to a Utah injury firm at no cost, with no attorney fees unless we win.

Truck Routes Through Orem

Orem sits between Utah Lake and the mountains, so north-south freight has few options: I-15 on the west, Geneva Road along the lake, State Street through the middle, and 800 North feeding Provo Canyon. Where a truck met Orem traffic decides who investigates and what evidence exists.

I-15 between the Orem interchanges

The University Parkway and 800 North interchanges sit close together, so trucks merging on and off share a short stretch with commuters changing lanes. Sideswipes on a trailer's blind side and rear-end impacts into slowed traffic are the typical cases.

Geneva Road (SR-114)

Geneva Road runs north near the east shore of Utah Lake from Provo through Orem and Lindon, crossing University Parkway and 800 North. Trucks serving businesses on the west side of the city use it as an alternative to the freeway, and crashes gather at the signalized crossings.

State Street (US-89)

Orem's old main street brings delivery trucks to strip retail and restaurants along long blocks. Trucks turning into narrow driveways, or stopping in the right lane to unload, set up rear-end and pedestrian crashes.

800 North (SR-52) to Provo Canyon

The connector from I-15 to US-189 carries trucks, trailers and canyon traffic past Timpanogos Regional Hospital. Stopping distance behind a loaded truck at its signals is usually what gets disputed.

University Parkway near UVU

SR-265 brings supply and delivery trucks to Utah Valley University and the mall frontage, alongside UVX buses, students and shoppers. Trucks making wide right turns or crossing several lanes to reach a loading entrance are a recurring danger to people on foot and on bikes.

Investigating agencies in Orem

The Orem Police Department handles crashes on city streets, including Geneva Road and State Street, and fields its own major accident investigation team for serious collisions; the Utah Highway Patrol handles I-15. A claim involving a UDOT work zone, a UTA bus or an Orem City vehicle requires a notice of claim within one year under Utah Code § 63G-7-402.

Medical Bills After an Orem Truck Collision

Utah is a no-fault state for the first layer of medical costs, so your own personal injury protection pays before the trucking company's insurer does: not less than $3,000 in medical expenses, plus up to $250 a week in lost income at 85% of gross, for as long as 52 weeks (Utah Code § 31A-22-307). Read our PIP explainer.

Emergency treatment at Timpanogos Regional Hospital, or a transfer to the Level II trauma center at Utah Valley Hospital in Provo, will pass that figure quickly. A claim for pain, suffering and lasting losses opens under Utah Code § 31A-22-309 if you have:

  • Medical costs beyond $3,000.
  • A broken bone.
  • Objectively documented permanent impairment or disability.
  • A permanent disfigurement.
  • Dismemberment.
  • A fatal injury.

With the threshold met, the trucking company and its insurer answer for the full claim, including future care and lost earning capacity. When the at-fault vehicle carries too little coverage or none, your own UIM or UM policy is the next layer, and an uninsured motorist claim does not require the threshold. More on underinsured motorist claims.

Comparative Fault Against a Carrier

Utah Code § 78B-5-818 reduces your recovery by the percentage of fault assigned to you and bars it unless the defendants' combined fault exceeds yours. A driver found 30% at fault recovers 70%.

On I-15, the carrier will say you merged into the trailer's blind side; on Geneva Road or State Street, that you stopped short in front of a truck. Electronic logs, GPS, dashcam footage and engine data can show the driver's speed and hours, but only if they are preserved before routine deletion.

Filing windows

Four years for most crash injury suits under § 78B-2-307, two years for wrongful death under § 78B-2-304, and one year for a notice of claim against UDOT, UTA, Utah County or Orem City. See every deadline explained.

Federal Trucking Rules That Matter in Orem Cases

Hours-of-service limits

A property-carrying driver may drive no more than 11 hours within a 14-hour window that starts after 10 consecutive hours off duty, and must take a 30-minute break once 8 hours of driving have passed (49 CFR 395.3). Fatigue is a common question in long-haul I-15 crashes, and the logs are how it gets answered.

Logs and ELD data

Carriers must keep records of duty status and supporting documents for at least six months (49 CFR 395.8(k)(1)) and a backup copy of ELD records for six months on a separate device (49 CFR 395.22(i)). After that, proof of how long the driver had been on the road can lawfully disappear.

Phones in the cab

Federal rules bar commercial drivers from texting while driving (49 CFR 392.80) and from using a hand-held mobile phone while driving (49 CFR 392.82), and bar carriers from allowing either. Phone records can matter as much as the crash report.

Pressure from the company

A carrier may not schedule a run that can only be completed by speeding (49 CFR 392.6), and may not let an ill or fatigued driver operate (49 CFR 392.3). Dispatch records and delivery windows can show pressure that started with the company, not just the driver. Our truck claims guide covers who can be named.

Hit-and-run by a commercial vehicle

A truck driver may never notice a sideswipe. If the vehicle cannot be identified, your UM coverage may pay, and if it never touched you, Utah requires clear and convincing proof beyond your own testimony that the vehicle existed. Report the crash immediately.

What to Do After an Orem Truck Crash

  • Call 911. Orem Police respond on city streets and UHP on I-15; get the case number and the agency before you leave.
  • Be evaluated the same day at Timpanogos Regional Hospital on 800 North or another emergency department. Internal injuries from a truck impact can take hours to show.
  • Photograph the USDOT number, the company name, the trailer and plates, and where the vehicles came to rest.
  • Ask witnesses for contact information; drivers on I-15 will not stop again.
  • Open a PIP claim with your insurer, and do not sign anything the trucking company's adjuster sends.

If an Orem truck case is filed, it goes to the Fourth Judicial District Court for Utah County at 137 North Freedom Boulevard in Provo. Most resolve before trial, but evidence requests go out in the first week. Call (801) 921-5134 or ask for a free case review. Free consultation. No attorney fees unless we win. Hablamos Español.
