Orem Rideshare Accident Lawyer

Hurt in an Uber or Lyft in Orem? Which policy pays turns on the driver's app status at the moment of the crash, and our legal team works to prove it. Free consultation, no attorney fees unless we win. Hablamos Español.

Orem's rideshare traffic follows the class schedule and the shopping calendar. Utah Valley University draws commuters and students to the west side of town, University Place at 575 East University Parkway pulls in shoppers and moviegoers, and riders connect with FrontRunner at Orem Central Station, 1350 West 900 South. UVX buses serve the campus corridor, yet plenty of people still book a car for the last leg. After a crash, the first thing to settle is which insurance policy the driver's app switched on.

Required rideshare coverage in Utah ranges from a $50,000-per-person minimum to $1,000,000 per occurrence, depending on what the driver was doing in the app. Whether you were in the back seat, in a car the rideshare vehicle struck on University Parkway, crossing near campus, or driving for Uber or Lyft between classes, we determine which layer was active and build the case on it.

Three Stages of a Shift, Three Levels of Insurance

Utah Code § 13-51-108 sets the minimum insurance according to the driver's app status. On an Orem street it breaks down like this:

  • Not logged in. The rideshare rules do not reach the trip, and the driver's personal policy is the source of coverage. A personal insurer may exclude rideshare use (§ 13-51-108(11)), so if there is any doubt about whether the app was running, expect a dispute over it.
  • Logged in and waiting for a request. Utah calls this the waiting period and requires at least $50,000 in liability coverage for any one person, $100,000 for all injured people, and $30,000 for property damage.
  • Request accepted, or rider in the car. The prearranged ride runs from acceptance until the passenger exits. During that window the required liability coverage is at least $1,000,000 per occurrence, with PIP, uninsured motorist and underinsured motorist coverage included as Utah law requires.

Near UVU a driver may tap to accept a request while still rolling through a campus entrance, which is exactly why the time stamp matters. We ask for the acceptance time, the trip record and location data rather than relying on the insurer's account. Our Utah rideshare insurance guide goes deeper on each stage.

Who Has a Rideshare Claim in Orem

You do not have to be the paying rider to have a claim. We talk with:

  • Passengers headed to class, to University Place, or to catch a train at Orem Central.
  • People in other vehicles struck by a driver working for Uber or Lyft.
  • Students on foot, bikes or scooters around the UVU approaches and along State Street.
  • Uber and Lyft drivers injured by another motorist while logged in or on a trip.

Each role can reach a different policy, sometimes several. For a crash that did not involve a rideshare vehicle, see our Orem car accident lawyer page.

The Utah Rules Behind an Orem Rideshare Claim

PIP pays the first layer of medical expenses and lost income no matter who was at fault (§ 31A-22-307; Utah no-fault explained). Section 78B-5-818 reduces your recovery by your share of fault and bars it unless the defendants' combined share is larger. You generally have four years to sue, but a claim involving a UTA vehicle or an Orem City vehicle requires a notice of claim within one year (§ 63G-7-402). Our deadlines guide covers the exceptions.

Orem Details That Shape the Case

Orem Police investigate crashes on city streets and field a major accident investigation team for serious collisions; the Utah Highway Patrol handles I-15. Timpanogos Regional Hospital on 800 North has a 24-hour emergency department, and Utah Valley Hospital in Provo is the region's Level II trauma center. Utah County lawsuits go to the Fourth Judicial District Court at 137 North Freedom Boulevard in Provo. Because many riders are students who leave town after the semester, we collect witness statements early. For broader local claims, see our Orem personal injury page.

Damages in an Orem Rideshare Claim

  • Out-of-pocket losses: medical care, future treatment, lost pay, and reduced ability to earn, including when an injury sets back school and work plans.
  • General damages: physical pain, anxiety in traffic, and the ordinary activities an injury takes away.
  • Continuing care: surgery, rehabilitation and assistance at home when an injury does not fully heal. Our article on Uber passenger settlement amounts covers what raises or lowers value.
  • Loss of a family member: the wrongful death claims available to survivors under Utah law.

Orem Rider Questions

What Orem Riders Ask After an Uber or Lyft Crash

I'm a UVU student hurt as a passenger in a Lyft. Who pays my bills?

PIP covers the first medical bills and part of lost wages regardless of fault. Beyond that, the at-fault driver's liability coverage is responsible, and because you were on a trip, the $1,000,000 tier applies if your own driver caused the crash.

The driver was idling in a parking lot waiting for a request and backed into me. What coverage is there?

A logged-in driver without an accepted request is in the waiting period, which requires at least $50,000 per person, $100,000 per occurrence and $30,000 for property damage. Your own underinsured motorist coverage may add to that if those limits fall short.

Uber told me the driver is not its employee. Does that end my claim?

No. Utah's insurance requirements for rideshare driving apply either way, and the company must provide coverage from the first dollar if the driver's own required coverage lapses.

What does an Orem rideshare accident lawyer charge?

The first consultation is free, and we work on contingency. You pay nothing up front, and no attorney fees unless we win.

What is the filing deadline in Utah?

Generally four years for injury claims and two for wrongful death. If a UTA bus, a UVX vehicle or another government vehicle was involved, notice is due within one year.

What evidence should I save?

The trip screen and receipt, the driver's name, photo and plate, in-app messages, and photos of the scene. Write down witnesses' names too, since classmates and shoppers scatter quickly.
