Park City Rideshare Accident Lawyer

Hurt in an Uber or Lyft in Park City or on the drive up I-80? The driver's app status decides which policy pays, and we track it down. Free consultation, no attorney fees unless we win. Hablamos Español.

Rideshare in Park City follows the ski calendar. Visitors land in Salt Lake, ride up I-80 through Parley's Canyon, and then depend on cars between their lodging, the Park City Mountain and Deer Valley base areas, and Main Street. Evenings bring pickups on a narrow, steep Main Street lined with angled parking, and a storm can turn the canyon drive into a string of slide-offs. Many of the people in the back seat are from out of state.

That mix raises questions an ordinary local crash does not: a driver and a passenger from different states, a rideshare policy, perhaps a rental car in the other lane. Utah's rideshare insurance rules apply to rides given here even when the passenger lives elsewhere, and our legal team uses them to find the coverage that matches the moment of the crash.

How Rideshare Coverage Works on a Park City Trip

Utah Code § 13-51-108 sets the insurance by the driver's app status. For a trip up from the airport or across town:

  • Not logged in. Only the driver's own policy applies, and that policy may exclude rideshare driving. If the driver says the app was off, the trip records will confirm it or not.
  • Logged in and waiting. Coverage must be at least $50,000 per injured person and $100,000 per crash, with $30,000 for property damage. Those are the numbers for a driver circling Main Street waiting for the next request.
  • On a ride. From the moment a request is accepted and through the trip, Utah requires at least $1,000,000 per occurrence in liability coverage, plus PIP and uninsured/underinsured motorist coverage where required.

Winter makes the fight harder, not easier. The insurer may say the driver was between requests, or that the snow, not the driver, caused the slide. Drivers are expected to adjust to the road in front of them, and the app data settles the period. See our guide to rideshare insurance in Utah.

Who Has a Claim After a Park City Rideshare Crash

Claims come from every side of the vehicle:

  • Visitors and locals riding to the resorts, to Main Street, or to Salt Lake City International Airport.
  • Drivers on SR-224, SR-248 or I-80 struck by a rideshare vehicle.
  • People walking on Main Street or at a resort drop-off area.
  • Rideshare drivers hit by another motorist, including on canyon runs to and from Salt Lake.

For collisions that did not involve Uber or Lyft, see our Utah car accident page. Our Park City personal injury page covers the local roads, the ski-season traffic and the agencies that respond.

Utah Law in Brief

PIP pays the first medical bills and part of lost wages without regard to fault (§ 31A-22-307; our no-fault guide has the details). You recover only if the defendants' combined fault is greater than yours, and your award is cut by your percentage (§ 78B-5-818). Most injury suits carry a four-year deadline, but a claim tied to a government vehicle, a snowplow or a road crew requires a notice of claim within one year; see every Utah deadline.

Park City Details That Affect the Claim

Park City Police handle crashes inside city limits, the Summit County Sheriff's Office covers Kimball Junction and the unincorporated county, and the Utah Highway Patrol works I-80. Intermountain Park City Hospital has an emergency department. Summit County cases are filed in Utah's Third Judicial District. Out-of-state riders often fly home before treatment is finished, so we keep the medical records and the claim moving from wherever you live.

What You Can Recover

  • Medical and financial losses: emergency and follow-up care, medical travel, missed work, and lost earning capacity.
  • Non-money harm: pain, a ruined trip, and the months of limits that follow.
  • Future care: ongoing treatment for injuries that do not fully heal. Our piece on Uber passenger settlement amounts explains what moves a claim's value.
  • Wrongful death: claims for a family after a fatal crash.

Park City Questions

Rideshare Crash Questions From Park City

I live out of state and was hurt in an Uber in Park City. Can I still bring a claim?

Yes. The crash happened in Utah, so Utah's rideshare insurance rules and injury law generally apply. We can handle the claim while you recover at home.

My Lyft slid off the road in a snowstorm. Is anyone responsible?

Often, yes. Snow does not excuse a driver who was going too fast for the conditions or following too closely. If your driver was at fault, the coverage for an active ride applies to your injuries.

The driver was between rides when he hit my car on SR-224. What coverage is there?

A driver who is logged in and waiting for a request must carry at least $50,000 per person and $100,000 per crash in liability coverage. Your own underinsured motorist coverage may add to that.

What will it cost me?

The first consultation is free. We are paid on contingency: you pay nothing up front, and no attorney fees unless we win.

How long do I have?

Generally four years for an injury claim and two years for wrongful death. A notice of claim to a government entity is due within one year.

What should I do before I leave Park City?

Get examined, screenshot the trip and the receipt, photograph the vehicles and the road conditions, and collect witness contacts. Get the report number from the agency that responded.
