Provo Rideshare Accident Lawyer

Hurt in an Uber or Lyft in Provo? Coverage turns on what the driver's app showed at the moment of impact, and we know how to prove it. Free consultation, no attorney fees unless we win. Hablamos Español.

A lot of Provo rides are short: a student heading from an apartment near campus to a job downtown, a late trip home after a BYU game, a run between Provo and the UVU campus in Orem, or a pickup at Provo Central after a FrontRunner train from Salt Lake. Short trips still end in serious crashes, and when one does, the first question is not who was careless. It is which insurance policy was switched on.

Utah's rideshare insurance rules swing from $50,000 per person to $1,000,000 per occurrence depending on the driver's status in the app. Whether you were riding in the car, driving the car it hit, walking across University Avenue, or behind the wheel for Uber or Lyft yourself, our legal team works out which layer applies and builds the claim around it.

Three App Periods, Three Different Coverage Pictures

Utah Code § 13-51-108 ties the required insurance to what the driver was doing in the app. Here is how that plays out on a Provo street:

  • Logged out. The driver is just another motorist, so the claim runs against the driver's personal auto policy. Utah lets personal insurers exclude rideshare use, which is one more reason the app status has to be pinned down (§ 13-51-108(11)).
  • Logged in, no ride accepted. The statute calls this the waiting period. Required liability coverage is at least $50,000 for one person, $100,000 for everyone hurt, and $30,000 for property damage.
  • Ride accepted or passenger on board. A "prearranged ride" starts the moment the driver accepts the request, so the drive to your pickup counts. Liability coverage of at least $1,000,000 per occurrence is required, along with PIP and uninsured/underinsured motorist coverage where Utah law calls for them.

The gap between the second and third rows can be a matter of seconds, such as a request accepted just before the light changed on University Parkway. We ask for the trip log, the acceptance time stamp and the GPS trail rather than relying on the insurer's summary. Our rideshare insurance guide walks through each period in more depth.

Who Can Bring a Rideshare Claim in Provo

The app does not decide who has a claim. People we hear from include:

  • Riders in the back seat on the way to campus, downtown, or Provo Airport.
  • Drivers and passengers in other cars struck by someone driving for Uber or Lyft.
  • People on foot, bikes or scooters near BYU and downtown, where pickups and drop-offs happen right at the curb.
  • Rideshare drivers hurt by another motorist while working, including students who drive between classes.

Each of those positions can open a different policy, and sometimes more than one. For a crash that did not involve a rideshare at all, see our Provo car accident lawyer page.

Utah Rules That Shape a Provo Rideshare Claim

Personal injury protection pays the first layer of medical bills and lost wages no matter who caused the crash (§ 31A-22-307; see our no-fault guide). Fault is divided under § 78B-5-818, and you recover nothing unless the people you sue carry more of it than you do. Most injury suits must be filed within four years, but a claim involving a UTA bus or a Provo City vehicle needs a notice of claim within one year (§ 63G-7-402). Every deadline is on our Utah deadlines page.

Where Provo Rideshare Cases Get Complicated

Provo Police handle crashes in the city, BYU Police respond on campus, and the Utah Highway Patrol takes I-15, so ask which agency responded and get the case number. Serious injuries usually go to Utah Valley Hospital, a Level II trauma center, and its records become the backbone of the medical claim. Lawsuits over Utah County crashes are filed in the Fourth Judicial District Court at 137 North Freedom Boulevard. Expect the insurer to argue about the app period first, then about whether you really needed the treatment you received. Our Provo personal injury page covers local claims more broadly.

What a Provo Rideshare Claim Can Include

  • Money losses: hospital and therapy bills, future treatment, missed shifts, and reduced earning capacity.
  • Human losses: pain, anxiety about getting back in a car, and the activities an injury takes away.
  • Care that continues: surgery, rehabilitation and help at home when an injury is permanent. Our article on Uber passenger settlement amounts explains what moves a case's value.
  • A family's losses: when a crash is fatal, the wrongful death claims Utah allows surviving family members.

Provo Rider Questions

Questions After a Provo Uber or Lyft Crash

The driver had just accepted a ride and was on the way to a pickup when he hit me. Is that the $1 million period?

Yes. Under Utah's statute, a prearranged ride begins when the driver accepts the request, so the drive to the pickup falls within the period that requires at least $1,000,000 in liability coverage.

I was riding in the Lyft and my driver was not at fault. Who pays?

The other driver's liability policy is responsible first. If it is too small, the uninsured and underinsured motorist coverage carried during the ride, and your own UIM coverage, may add to it.

The rideshare driver's personal insurance had lapsed. Is there still coverage?

Yes. Utah requires the rideshare company to step in: if a driver's required coverage lapses, the company must provide it beginning with the first dollar of the claim.

What does it cost to hire a Provo rideshare accident lawyer?

The consultation is free and we work on contingency. You pay nothing up front, and no attorney fees unless we win.

How long do I have to file after a rideshare crash in Utah?

Most injury claims must be filed within four years and wrongful death claims within two. If a UTA bus or another government vehicle was involved, a notice of claim is due within one year.

What should I save from the app?

Screenshots of the trip, the driver's name and plate, the receipt, and any in-app messages. They help prove the driver's status at the moment of the crash, and trip details can be harder to get later.
