American Fork Slip and Fall Lawyer

Injured in a fall on a downtown American Fork sidewalk, in a store along State Street or on an icy lot near the FrontRunner station? The party that controlled that property may owe you compensation. Free consultation, and no attorney fees unless we win.

American Fork pairs an older downtown along Main Street with newer retail, apartments and commuter parking closer to I-15. Falls happen at both ends of town: worn steps and uneven concrete at older storefronts, and broad parking areas at newer centers where a slick patch or a pothole is easy to miss in low winter light.

The city states that it is not its policy to keep bare pavement on city streets, and its snow rules forbid pushing snow or ice from private property into the public right-of-way (American Fork Streets Department). For a business or landlord, cleared snow has to stay somewhere on the property, and piles that drain across a walkway and refreeze overnight are a steady source of falls.

Proving an American Fork Fall

Most falls never generate a police report. The claim depends on showing that a hazard existed, that the business or landlord knew about it or would have found it with ordinary checks, and that it caused both the fall and your injury.

Ask the store to prepare an incident report and note the name of the manager you spoke with. Send a written request, the same day if you can, that surveillance video be kept. Save your shoes and the clothes you wore. If you rent, pull together the lease and any earlier messages to the property manager about the stairs, lights or snow.

Owner Duties Under Utah Law

The duty owed depends on the reason you were on the property:

  • Customers and paying visitors are entitled to an owner who inspects for dangers and repairs them or posts a warning.
  • Invited social guests must be told about dangers the host is aware of.
  • Uninvited entrants are owed considerably less.

A common response is that the hazard was obvious. That can reduce a recovery, but it does not end a claim when the owner should have expected people to cross the area anyway, such as the only path from a parking stall to a store door.

Shared fault. Utah Code § 78B-5-818 lets you recover only when the defendants' combined fault is greater than yours, and it subtracts your percentage from the award. Adjusters often ask what you were carrying, where you were looking and why you did not use another entrance.

Deadlines. Most personal injury suits must be filed within four years. For a fall on American Fork City property, a city sidewalk or other government ground, including UTA's FrontRunner station, a written notice of claim is required within one year (§ 63G-7-402). See our statute of limitations page for the full list.

Common Places for American Fork Falls

Main Street downtown, where older buildings have raised thresholds, narrow steps and sidewalks cracked by age and tree roots, and where a building owner and a tenant business may split maintenance duties between them.

State Street and the retail areas near the I-15 interchanges, where store entrances track in slush and large lots are plowed into piles that melt and refreeze, and newer apartment communities near the freeway with exterior stairs and shared walkways.

Public property such as city sidewalks, parks and the FrontRunner station at 782 West 200 South, where the owner is a government entity and the one-year notice applies. If a vehicle was involved, our American Fork car accident page explains that claim, and our American Fork personal injury page covers other injuries.

Hazards We See in American Fork

Refrozen meltwater below snow piles, uneven concrete at older storefronts, missing or short handrails, wet floors without a warning sign, parking lot potholes, and poorly lit stairways at apartment buildings.

Common Fall Injuries

Fractured wrists, ankles and hips, concussions, shoulder injuries from catching yourself, and back strains are frequent. Intermountain American Fork Hospital at 170 North 1100 East has an emergency department and is a Level III trauma center; the most serious injuries may be transferred to a higher-level center.

Compensation in a Fall Case

  • Economic losses: medical bills, therapy, future care, lost wages and reduced earning capacity.
  • Non-economic losses: pain, stress and the everyday activities the injury took away.
  • Long-term needs: care, equipment and help at home if the injury does not fully heal.

How the Defense Responds

Expect claims that you should have seen the ice, that staff had no time to find the spill, or that a tenant or contractor was responsible for clearing the walk. Photos, weather data, plowing and salting logs, and written complaints made before your fall answer those arguments. If a lawsuit is necessary, Utah County's Fourth Judicial District Court hears cases in Provo and at its American Fork courthouse at 75 East 80 North. Common Questions

American Fork Fall Questions

I fell on ice in a store parking lot in American Fork. Is the store responsible?

It may be, along with the property owner or a snow removal contractor. The lease between the store and its landlord, and any plowing contract, usually decide who had the duty to clear and salt that lot.

I slipped at the FrontRunner station. What changes?

UTA is a government entity, so a written notice of claim must be filed within one year. Missing that notice can bar the claim.

What if I was partly responsible for the fall?

Your award is reduced by your percentage of fault, and you recover nothing unless the defendants' combined fault is greater than yours (Utah Code § 78B-5-818).

How are your fees paid?

You pay nothing up front, and no attorney fees unless we win. The fee comes from the recovery, and the written fee agreement explains how case costs are handled.

How long do I have to bring a claim?

Usually four years for a claim against a private owner, and one year to file a notice of claim when a city, county or other government entity owns the property.

What evidence should I collect?

Photos of the hazard and the lighting, your shoes, the incident report number, names of witnesses and employees, and your medical records starting from the first visit.
