Salt Lake County

Herriman Slip and Fall Lawyer

Hurt in a fall at a Herriman store, an HOA clubhouse, an icy sidewalk or a city facility? Whoever controls that property may owe you compensation. Free consultation. You pay nothing up front, and no attorney fees unless we win.

After a fall in Herriman, the first thing to settle is who owns the ground you landed on, because the answer changes both the rules and the deadline. A grocery aisle at Lee’s Marketplace near Academy Village belongs to a private business. The Ice Ribbon in Crane Plaza at City Hall is run by Herriman City. Trails in Rose, Yellow Fork and Butterfield canyons are Salt Lake County parkland. Where a homeowners association runs a clubhouse, pool or common walkway, the association usually controls it. And the sidewalk in front of a house falls under the city’s rule that property owners keep adjacent sidewalks clear of snow and ice.

Winter is a big part of the picture. Herriman sits at the southwest edge of the valley, and its crash records reflect it: in UDOT’s data, 8.3% of the city’s crashes happened on snow, ice or slush, against 5.9% regionally, and December was the busiest month over 2018 through 2024, as reported on our Herriman most dangerous roads page. The same freeze-and-thaw cycles that cause those crashes leave ice on parking lots, store entrances and stairways.

Building a Herriman Fall Claim

The legal elements are simple to state and harder to prove. You must show the hazard was real, that the business or owner knew about it or would have found it with reasonable inspection, and that it caused you to go down. Nobody files a police report for a fall, so the proof comes from what is collected in the first hours.

At a shopping center, the landlord may control the parking lot and sidewalks while the tenant controls the inside of the store, and a snow contractor may have been hired to plow and salt. Note the exact spot, ask the manager for a written incident report, and send a letter asking that surveillance video be preserved before it records over.

The Duty Depends on Why You Were There

Utah law looks at the visitor’s status:

  • Business visitors, such as shoppers and stadium guests, are owed reasonable inspection and repair, or a clear warning.
  • Social guests at someone’s home are owed a warning about dangers the host knows of.
  • Trespassers are owed far less protection.

“It was open and obvious” is a standard defense. It does not settle the matter when the owner had reason to expect customers to cross the hazard anyway, such as an iced-over main entrance with no other way in.

Comparative fault. Under Utah Code § 78B-5-818, you can recover only if the defendants’ combined fault exceeds yours, and your share reduces the award. Insurers in fall cases ask about footwear, phone use, and whether you were hurrying across a dark lot.

Deadlines differ by owner. Claims against a private business or landlord generally have four years. A fall on property owned by Herriman City, such as Crane Plaza or a city park, or on Salt Lake County land, requires a written notice of claim within one year (§ 63G-7-402). See our statute of limitations page for details.

Herriman Places Where Falls Happen

Crane Plaza and the Ice Ribbon. The city runs a seasonal skating ribbon at 5355 West Herriman Main Street and requires every skater to sign a waiver addressing falls and collisions. An insurer will raise that waiver, but how far it reaches depends on its wording and on what actually caused the injury. Because the city owns the plaza, the one-year notice rule applies.

Herriman Towne Center and Academy Village. The Commons at Herriman Towne Center is still filling in, with a newer signal at Dragonfly Lane and Towne Commons Drive, and the Real Vista Drive and Juniper Crest Road project near Lee’s Marketplace adds a link to Mountain View Corridor. Building next to operating stores tends to mean temporary walkways, uneven transitions and fresh concrete beside customers. A fall there is usually a claim against a private owner or tenant, with the four-year deadline.

Zions Bank Stadium and Blackridge Reservoir. The stadium at 14787 South Academy Parkway puts crowds on stairs, walkways and parking lots on game nights. Blackridge Reservoir, which the city manages, has a swimming beach, restrooms open April through October, and a paid weekend parking lot in summer. For vehicle crashes, see our Herriman car accident page; for other injuries, our Herriman personal injury page.

Common Hazards in a Growing City

Ice on north-facing entrances and steps, plowed snow piles that melt across a walkway and refreeze overnight, cracked or heaved concrete, missing handrails, dim parking lots, wet floors inside store entrances during storms, uneven seams where new pavement meets old, and gravel tracked onto sidewalks from building sites.

Injuries From Falls

Falls commonly cause broken wrists, ankles and hips, torn shoulders, back and neck injuries, and head injuries, with older adults at particular risk. Intermountain Riverton Hospital at 3741 West 12600 South is a Level IV trauma center; severe injuries go on to Intermountain Medical Center in Murray.

What You Can Recover

  • Medical and income losses: emergency care, surgery, therapy, medication and time away from work.
  • Personal losses: pain, limits on daily life, and a recovery that can stretch for months.
  • Future costs: continuing care and lower earning ability when an injury is permanent.

Defenses You Should Expect

The owner’s insurer may say the spill had just happened, that a contractor handled snow removal, that the ice was a natural winter condition, or that you were not watching your step. Inspection and salting logs, store video, weather records for the day and a written incident report are the usual answers. A Herriman fall lawsuit is filed in the Third Judicial District Court for Salt Lake County, which has a courthouse in West Jordan at 8080 South Redwood Road. Fall Questions

Herriman Slip and Fall FAQs

I fell at the Ice Ribbon in Crane Plaza. Can I bring a claim if I signed a waiver?

Possibly. The effect of a waiver depends on its wording and on what caused the fall. Because Herriman City owns and runs the Ice Ribbon, a written notice of claim must be filed within one year, so have the waiver and the facts reviewed early.

I slipped on an icy sidewalk in front of a house. Who is responsible?

Herriman’s snow-removal rules say property owners must keep the sidewalks next to their property clear of snow and ice, but whether a homeowner owes you damages depends on the facts. If city work or city property caused the hazard, a one-year notice of claim applies.

Does being partly at fault end my claim?

No. Under § 78B-5-818 your recovery is reduced by your share of fault, and you can recover as long as the defendants’ combined fault is greater than yours.

How do you charge?

You pay nothing up front, and no attorney fees unless we win. The fee comes out of the recovery, and the written agreement explains how case costs are handled.

I fell in an HOA clubhouse or common area. Who do I claim against?

Usually the homeowners association that controls the area, and its liability insurer. If a management company or contractor handled maintenance, it may share responsibility.

What should I do right after a fall?

Get medical care first. Then tell the manager or the HOA in writing, take pictures of the exact spot and of the shoes you had on, and write down who was nearby. If ice was involved, save a screenshot of that day’s weather.
