Herriman Rideshare Accident Lawyer

Hurt in an Uber or Lyft crash in Herriman, or hit by someone driving for one? The coverage available depends on where the driver was in the trip when the collision happened. Free consultation. You pay nothing up front, and no attorney fees unless we win. Hablamos Español.

Herriman sits a long way from most of the places its residents need a ride to. TRAX stops short of the city at the Red Line’s Daybreak Parkway station, 11405 South Grandville Avenue in South Jordan, so for many trips downtown or to the airport the choice is a ride to the station or a car the whole way. Inside the city, trips begin and end at places like Zions Bank Stadium at 14787 South Academy Parkway on game nights, the shops around Herriman Towne Center, and City Hall’s Crane Plaza during events. Many of those rides use Mountain View Corridor, Bangerter Highway or 13400 South for at least part of the way.

Before anyone argues about fault in a rideshare crash, someone has to establish what the driver’s app showed at that instant, because Utah sets a different insurance requirement for each stage. Those requirements come from the state, and Herriman cannot alter them: § 13-51-109 makes the rideshare statute supersede local regulation, with airports the only exception.

Coverage at Each Stage of a Trip

Utah Code § 13-51-108 ties the required insurance to what the driver was doing in the app:

  • Logged out. Only the driver’s personal auto policy is in play, and Utah allows personal insurers to exclude losses arising from rideshare driving (§ 13-51-108(11)). Expect that insurer to scrutinize whether the app was truly off.
  • Logged in, waiting for a request. The statute calls this the waiting period. Required liability coverage is at least $50,000 per person, $100,000 for everyone hurt in the occurrence, and $30,000 for property damage, plus PIP and uninsured and underinsured coverage where Utah law calls for them.
  • Ride accepted, through drop-off. A prearranged ride starts when the driver accepts the request in the app and ends when the passenger gets out (§ 13-51-102). For that entire stretch the coverage must include at least $1,000,000 in liability per occurrence, along with PIP and UM/UIM coverage.

The gap between $50,000 and $1,000,000 can come down to seconds, such as a driver idling in a Towne Center parking lot who taps accept just as the collision happens. Proving which side of that line the crash fell on takes the company’s own data: when the request was accepted, the trip log and the phone’s location history, checked against the receipt and messages in the rider’s app. Our Utah rideshare insurance guide goes through each stage in more depth.

People Who Can Claim Against the Coverage

The insurance on a rideshare trip protects more people than the passenger:

  • Passengers picked up at a Herriman home, the stadium, or the TRAX station in Daybreak.
  • Drivers of other cars struck by a rideshare vehicle on Mountain View Corridor, Bangerter Highway, 13400 South or a subdivision street.
  • People walking or riding bikes who are hit by a driver glancing at the app for the next pickup. Our Herriman pedestrian accident page covers claims by people on foot.
  • Rideshare drivers injured by another motorist while logged in.

Some people have more than one source. A passenger hurt by a third driver may have a claim against that driver’s insurer and, if those limits fall short, against the underinsured coverage on the rideshare policy. For a crash with no rideshare vehicle at all, our Herriman car accident page is the better fit.

Utah Rules That Shape the Claim

Your own PIP pays early medical bills and part of lost income no matter who caused the crash (§ 31A-22-307; see Utah no-fault basics). Fault is compared under § 78B-5-818, so you recover only from defendants whose combined fault is greater than yours, less your own share. Most injury suits must be filed within four years (§ 78B-2-307), but a claim touching Herriman City, UDOT or another government body requires a written notice of claim within one year (§ 63G-7-402). The complete list is on our deadlines page.

Local Details in a Herriman Rideshare Case

A crash on Herriman’s own streets is worked by the city police department, headquartered at 5355 West Main Street, while the Utah Highway Patrol may take one on a state highway. If someone is cited, the Herriman City Justice Court in City Hall decides that ticket; it does not decide your injury claim. Intermountain Riverton Hospital at 3741 West 12600 South is a Level IV trauma center, and the gravest injuries move on to the Level I center at Intermountain Medical Center in Murray. A lawsuit, if one is needed, is filed in Salt Lake County’s Third Judicial District Court, which has courthouses in West Jordan and downtown Salt Lake City. Our Herriman personal injury page covers injuries that did not involve a vehicle.

What a Rideshare Claim Can Recover

  • Bills and lost pay: emergency care, follow-up treatment, missed work and any lasting loss of earning ability.
  • Pain and disruption: physical pain, nervousness about getting into a car again, and the activities the injury has taken away.
  • Future care: surgery, therapy and in-home help for injuries that will not fully heal. Our post on Uber passenger settlement amounts covers what drives value.
  • A death in the family: when a rideshare crash is fatal, the family may bring a wrongful death claim, which carries a two-year deadline.

Rideshare Questions

After an Uber or Lyft Crash in Herriman

My Uber crashed on the way home from Zions Bank Stadium. Which insurance pays?

Because the ride had been accepted, the policy covering the driver must carry at least $1,000,000 in liability coverage plus PIP and uninsured and underinsured coverage. If the rideshare driver caused the crash, that liability coverage responds. If another driver did, that driver’s insurer comes first, and the rideshare policy’s underinsured coverage may fill a gap.

Can Herriman pass its own rules for Uber and Lyft?

No. Utah Code § 13-51-109 makes the state rideshare law supersede local regulation of rideshare companies and drivers, except at airports. A Herriman crash follows the same statewide insurance rules as one anywhere else in Utah.

The driver says the app was off. How is that checked?

The companies keep data on when a driver logged in, when a request was accepted and where the car was. We ask for it early and compare it with your receipt, your in-app messages and photos from the scene.

What does a Herriman rideshare accident lawyer cost?

The first consultation is free, and the case is handled on a contingency fee. You pay nothing up front, and no attorney fees unless we win.

How long do I have to bring a claim?

Generally four years for an injury lawsuit and two years for wrongful death. If Herriman City, UDOT or another public body may share responsibility, a notice of claim is due within one year.

What should I save from the trip?

Screenshot the trip, the driver’s name and the vehicle in the app before they drop out of your history. Photograph the cars and the road, get witness phone numbers, ask for the police case number, and see a doctor the same day.
