Millcreek Rideshare Accident Lawyer
Injured in an Uber or Lyft in Millcreek? Which policy responds turns on what the driver's app was showing at the moment of impact, and proving that is the work. Free consultation. You pay nothing up front, and no attorney fees unless we win. Hablamos Español.
Millcreek is not served directly by TRAX or FrontRunner, and that shapes how people here move. With no rail platform of its own, the city leans on buses along 3300 South and 3900 South and, heavily, on Uber and Lyft: rides down to stations in the neighbouring cities, rides to the airport out along I-215, and rides home from the restaurants and the public market at Millcreek Common. St. Mark's Hospital on 3900 South generates its own steady traffic of patients, visitors and shift staff calling cars at all hours, and in season there is a stream of trailhead drop-offs and pickups up Mill Creek Canyon Road.
None of those are easy places to stop: the hospital entrance loop, the kerb on Chambers Avenue beside Millcreek Common, bench streets where a driver is squinting at house numbers, and a canyon road with nowhere to pull out. After a collision in one of them, the opening question is not who drove badly. It is which layer of insurance was live at that second. Utah keys that to the driver's app status, and the answer comes from state law rather than any city rule: § 13-51-109 preempts local regulation of rideshare companies and drivers, airports excepted.
Three App States, Three Levels of Coverage
Utah Code § 13-51-108 ties the required insurance to what the driver was doing in the app. For a Millcreek crash it works out like this:
- App closed. The statute's rideshare coverage never attaches, so the driver's personal auto policy is the starting point. Many personal policies carve out rideshare activity altogether (§ 13-51-108(11)), which is why an insurer will fight over whether the app was genuinely off at the moment of impact.
- App open, no ride accepted. The statute calls this the waiting period and sets the floor at $50,000 for one injured person, $100,000 for everyone hurt in the occurrence, and $30,000 in property damage.
- From acceptance through drop-off. Utah treats a prearranged ride as beginning the instant the driver accepts and ending when the passenger steps out (§ 13-51-102). Across that window the required liability limit is $1,000,000 per occurrence, alongside the PIP and uninsured and underinsured coverage Utah insurance law separately requires.
A driver idling on Chambers Avenue or holding outside the hospital can be in the waiting period one moment and on an accepted trip the next. Between those two moments sits the gap between fifty thousand dollars and a million. Rather than accept an adjuster's characterisation, we ask the company for the acceptance timestamp, the trip log and the GPS trace. Our guide to rideshare insurance in Utah walks each period.
Who Can Bring a Millcreek Rideshare Claim
That coverage can reach people on either side of the collision:
- Riders picked up at St. Mark's Hospital, Millcreek Common or a bench-neighbourhood address.
- Other motorists on 3300 South, 3900 South, Wasatch Boulevard or the I-215 ramps hit by a rideshare car.
- People on foot crossing to a bus stop, a hospital entrance or the Millcreek Common plaza.
- Drivers themselves, hurt by somebody else while logged into the app.
Which policies are available depends on your role and the driver's app status. If no rideshare car was involved, see our Millcreek car accident lawyer page.
Utah Law Behind a Millcreek Rideshare Claim
Three Utah rules shape what a rideshare claim is worth. PIP pays early treatment and part of your lost income irrespective of blame (§ 31A-22-307; how no-fault works). Comparative fault under § 78B-5-818 means you collect only where those you sue carry more of the blame than you do, with your own percentage deducted. And the filing window is four years for most injury suits, collapsing to a one-year notice the moment a UTA bus, a UDOT work zone, Salt Lake County or a Millcreek city vehicle enters the picture (§ 63G-7-402). Our Utah filing deadlines page lists them.
Millcreek Details That Shape the Case
Millcreek contracts its policing to the Unified Police Department of Greater Salt Lake, whose Millcreek Precinct sits at 1330 East Chambers Avenue and keeps four officers assigned to traffic; the Utah Highway Patrol usually handles I-215. Any citation written out of the crash is heard in the Holladay Justice Court, which has taken Millcreek's justice court cases since 2023 — that court decides the ticket, not your injury claim. St. Mark's Hospital on 3900 South is a Level II trauma center, so treatment records are often already local. If a lawsuit is needed, it goes to Salt Lake County's Third District Court at the Matheson Courthouse, 450 South State Street. For injuries that did not involve a vehicle, our Millcreek personal injury page has more.
Damages in a Millcreek Rideshare Case
- Money out and money lost: emergency and hospital charges, continuing treatment, missed work, and any permanent reduction in what you are able to earn.
- Human losses: pain, a reluctance to get back into a car, and the things you have simply stopped doing.
- Care still ahead: surgery, therapy and help at home where an injury does not fully resolve. Our article on what drives Uber passenger settlement amounts walks through the variables.
- Wrongful death: where a rideshare collision takes a life, the claim belongs to the family.

Questions After an Uber or Lyft Crash in Millcreek
My Lyft crashed on the way to St. Mark's Hospital. Whose insurance pays?
You were on an accepted trip, so the $1,000,000 layer applies, together with the PIP and UM/UIM coverage Utah requires. Where another motorist caused the collision, that driver's insurer is in the picture as well.
Does Millcreek have its own rideshare rules?
It does not. Section 13-51-109 preempts municipal regulation of rideshare companies and their drivers, with airports the exception, so a Millcreek crash runs on the same statewide coverage rules as one anywhere else in Utah.
The driver says the app was off. How do we check?
Uber and Lyft retain login, acceptance and GPS records. We request them early and check them against your ride receipt, your in-app messages, and anything photographed at the scene.
What does a Millcreek rideshare accident lawyer cost?
The consultation costs nothing and the case runs on contingency. You pay nothing up front, and no attorney fees unless we win.
How long do I have?
Generally four years to sue for injuries and two years for wrongful death. If UTA, Salt Lake County or Millcreek is involved, the notice of claim is due within one year.
What should I do at the scene?
Get checked out medically. Screenshot the trip in the app before it drops out of your history. Record the driver's name and plate, photograph both vehicles and the roadway, collect witness numbers, and get the police case number.
