Millcreek Dog Bite Lawyer

Bitten by a dog in Millcreek or up Mill Creek Canyon? Utah holds the owner or keeper responsible. Free case review. You pay nothing up front, and no attorney fees unless we win. Hablamos Español.

Millcreek has a bite pattern most cities do not, because Mill Creek Canyon is one of the few places in the valley where dogs are allowed off leash at all. The canyon runs on an odd and even day rule: dogs may be off leash only on odd-numbered calendar days, must be leashed throughout the canyon on even-numbered days, and must be leashed every day in the developed areas, meaning picnic grounds, parking lots, roadways and the housing along the lower road. A bite on an even day, or in a parking area on any day, happened where the dog was required to be restrained. Below the canyon, bites look like they do anywhere: a dog through a gate in Canyon Rim or East Millcreek, a dog loose in an apartment courtyard off 3300 South, or a delivery to a house where nobody put the dog away.

Few people relish the idea of making a claim against a neighbour, a friend, or their own landlord. It helps to know these claims are almost always paid by a homeowner's or renter's liability policy rather than out of anyone's savings. That is what the coverage exists for.

Utah's Dog Bite Statute

Utah is a strict liability state. Utah Code § 18-1-1 puts responsibility on whoever owns or keeps the dog. It does not matter that the animal had never shown aggression, and it does not matter that the owner had no warning. Utah gives no free first bite.

The exceptions are narrow. They reach certified police and military dogs working inside agency policy, harm to another animal that came uninvited onto fenced property, and certain trespassers hurt while the dog was properly confined. Outside those situations the statute simply applies.

Your own share of blame can still reduce the award. Damages run through § 78B-5-818, Utah's comparative fault provision, and that is the doorway an insurer uses for a provocation argument. What can be claimed is set out on our damages page.

Four years, and longer for a child. Adults generally have four years (§ 78B-2-307). For anyone injured before turning 18, the clock is paused until they reach majority (§ 78B-2-108). Our deadlines page has the full list.

After a Dog Bite in Millcreek

Have the wound cleaned and examined that day; St. Mark's Hospital at 1200 East 3900 South in Millcreek is a Level II trauma center. Then call animal control and make sure a bite report is written. That report is the single most useful piece of evidence in these cases: it fixes the date, the location, the dog and the owner while everything is fresh, and it lets the dog's vaccination status be checked. Millcreek is policed by the Unified Police Department's Millcreek Precinct, 1330 East Chambers Avenue, and animal control for the area is handled by Salt Lake County Animal Services. If the bite happened in the canyon, say so, because the responding agency may be different. Photograph the wounds as they heal, and write down the owner's name, address and insurer.

If the dog lives with a tenant, the landlord or property manager can matter too, particularly when a broken gate, a gap in a fence or a shared courtyard played a part. Renter's and homeowner's policies behave differently here, and which one applies often decides how much coverage there is.

Our guides on dog bite compensation and typical settlement ranges explain how these claims get valued.

Common Dog Bite Injuries

Punctures and tearing that need sutures or plastic surgery. Scarring on the face. Nerve and tendon damage through the hand and forearm, which is common because people put a hand up. Infection, which dog bites carry an unusually high risk of. Fractures from being knocked down. And in children, a fear of dogs that outlasts the wound by years.

What a Claim Can Include

A full claim should account for:

  • Medical care: the emergency visit, antibiotics, wound management and every follow-up appointment.
  • Scar revision: reconstructive work, including the staged procedures a growing child may need years afterward.
  • Income: your own missed shifts, or the leave a parent uses caring for an injured child.
  • Pain and fear: the injury itself, and the anxiety that tends to follow it.
  • Disfigurement: permanent scarring, which carries far more weight on a face or a hand.

How Insurers Respond

Common defenses: you provoked the dog, you came onto the property without permission, the scar will fade. In canyon cases expect the argument that you approached a dog the owner was entitled to have off leash, which is why the calendar date matters so much. Early offers often arrive before the wounds have healed or a surgeon has weighed in on revision. Photos taken over several weeks and a written opinion on future care are usually the strongest answer. Our Millcreek personal injury page covers other injuries in the city, and the Millcreek car accident page covers crashes.

Millcreek Dog Bite Questions

What People Ask After a Dog Bite in Millcreek

The dog never bit anyone before. Is the owner still liable?

Yes. Utah does not require a prior bite. Section 18-1-1 reaches the owner or keeper whether or not the dog had ever shown a sign of aggression.

It was a neighbor's dog. Will they pay out of pocket?

Rarely. Homeowner's and renter's liability coverage is what normally responds, and that is exactly the risk the policy is written to cover.

My child was bitten. How long do we have?

There is no rush created by the calendar for a child, because Utah pauses the limitations clock until they turn 18. There is a practical rush, though: the animal control report, the witnesses and the photographs are all far easier to secure in the first weeks than a year later.

The owner says I provoked the dog. Is my claim over?

No. Provocation is something the owner's side has to establish, not something you have to disprove. Even if a factfinder assigns you part of the blame, Utah's comparative fault rule trims the recovery proportionally rather than erasing it.

What does it cost to hire you?

Nothing to begin. You pay nothing up front, and no attorney fees unless we win.

The dog was off leash in Mill Creek Canyon. Does that matter?

Check the date first. Mill Creek Canyon allows dogs off leash only on odd-numbered days, requires a leash canyon-wide on even-numbered days, and requires one every day in picnic grounds, parking lots and along the roadway. A dog loose where a leash was required supports the point that the owner failed to control it. Either way, under Utah Code § 18-1-1 the owner is liable for the bite whether or not a leash rule was broken.
