Millcreek Motorcycle Accident Lawyer
Hit on a motorcycle on 3300 South, 3900 South, Highland Drive or up Millcreek Canyon? Free consultation, and no attorney fees unless we win.
Millcreek packs two very different rides into one city. Down in the valley, 3300 South, 3900 South and Highland Drive run past homes, churches and small shopping centers, with driveways opening straight onto traffic. At the east edge, Wasatch Boulevard leads to Millcreek Canyon Road, which narrows and bends as it climbs, with cyclists, trailhead traffic and downhill drivers sharing the pavement.
Each setting produces its own kind of motorcycle claim, and each needs different proof: signal and driveway evidence on the arterials, curve geometry and sight distance in the canyon. We help Millcreek riders gather it before it is gone. For injuries outside a motorcycle crash, see our Millcreek personal injury page.
Where Millcreek Riders Get Hit
On the east-west arterials the most common danger is a driver who turns left across oncoming lanes, or noses out of a parking lot, while a motorcycle is closing. Utah Code § 41-6a-903 covers both moves: a left-turning driver yields to oncoming traffic that is an immediate hazard, and a driver entering the road from a driveway yields to everything already on it.
Utah Law for Millcreek Motorcyclists
Lane filtering. On a multi-lane street posted at 45 mph or below, a rider may move up between lanes of stopped traffic at no more than 15 mph when it is safe to do so; § 41-6a-704(6) also permits it on multi-lane off-ramps and forbids it on on-ramps. That distinction matters at the I-215 interchanges. Our lane filtering explainer goes through each condition.
Helmet use. Utah's helmet mandate covers riders younger than 21. Whatever your age, § 41-6a-1505(6) bars the other side from treating a bare head as comparative negligence or offering it as evidence on negligence, injuries or mitigation.
Your bike carries no PIP. Under § 31A-22-302, PIP is optional on a motorcycle policy and does not cover a rider hurt while operating one, so the no-fault layer that governs car crashes in Utah does not sit between you and the at-fault driver. Early medical bills usually go through health insurance or med-pay; our motorcycle claims guide covers the sequence.
Low limits. The minimum bodily-injury limit on Utah auto policies issued or renewed on or after January 1, 2025 is $30,000 per person (§ 31A-22-304). A serious crash can exhaust that quickly; underinsured motorist coverage on your own policy may help close the gap.
Which government, which deadline. Millcreek's roads are divided among the city, Salt Lake County and UDOT. When a road defect, a signal or a public vehicle is involved, the notice of claim must reach the right entity within one year (§ 63G-7-402). Ordinary injury suits allow four years and wrongful death two; see our statute of limitations guide.
Millcreek Canyon and the Arterials
Millcreek Canyon Road draws riders for the same reasons it is risky: tight curves, shade that hides wet or sandy pavement, and cyclists climbing slowly around blind bends. Utah Code § 41-6a-601 requires every driver to keep a speed that is reasonable on curves and on narrow or winding roads, a rule that binds the car that crossed the center line and, the insurer will argue, you. Back in the valley, parked cars and mature trees along Highland Drive and the side streets shorten sight lines where drivers creep forward to look.
Millcreek contracts with the Unified Police Department, whose Millcreek office is at 1330 East Chambers Avenue, for crashes on city streets; the Utah Highway Patrol handles I-215. In the canyon, confirm which agency responded, and write down the case number either way.
Common Millcreek Motorcycle Crashes
A car pulling from a 3900 South driveway into the curb lane; a driver stacked in an I-215 on-ramp queue who changes lanes into a rider; a downhill vehicle drifting over the center line on a canyon curve; a rear-end impact while a rider waits at a signal on 3300 South. Potholes and broken pavement can contribute too, and then the first question is who owns that stretch of road.
Injuries and Nearby Trauma Care
Without a cage around them, riders suffer head trauma, facial and jaw fractures, broken forearms and hands from bracing, femur and knee injuries, spinal damage and deep abrasions. St. Mark's Hospital at 1200 East 3900 South, inside Millcreek, is a state-designated Level II trauma center, and Intermountain Medical Center in Murray is a Level I center.
What Compensation Covers
- Bills and lost pay: emergency care, surgery, physical therapy, time off work, and the cost to repair or replace the bike and gear.
- Human losses: pain, fear of getting back on a motorcycle, and missed family and work life during recovery.
- Long-term needs: future care, lost earning capacity, and adaptive equipment if an injury does not fully heal.
- Punitive damages: rarely awarded, and only for conduct such as drunk or drugged driving.
When the Insurer Points at the Rider
Adjusters on Millcreek claims tend to say the rider was speeding down the canyon, passing too close on Highland Drive, or hidden behind a parked car. Answers come from the scene: final rest positions, scrape marks, crush damage, sight lines around parked vehicles, doorbell and business video, and witnesses at the light. Under § 78B-5-818 you recover only if others' combined fault is greater than yours, so shaving a few points off matters. Our Millcreek car accident page covers local reports and roads, and our overview of how attorneys handle insurance claims explains the next stage.

Questions From Millcreek Riders
A driver pulled out of a driveway on 3900 South into my motorcycle. Who is at fault?
Often the driver who pulled out. Utah Code § 41-6a-903 requires a driver entering a road from anywhere other than another road, such as a driveway or parking lot, to yield to all vehicles approaching on that road. Photos of the driveway and nearby business video help prove it.
I crashed on Millcreek Canyon Road when a car crossed the center line. Do I have a claim?
Likely, if the driver's lane departure caused the crash. Utah Code § 41-6a-601 requires a speed that is reasonable on curves and narrow or winding roads. Expect the insurer to question your own speed, so photos of the curve and your bike's final position matter.
Can I filter to the front at the I-215 ramps?
On a multi-lane off-ramp, Utah Code § 41-6a-704(6) allows filtering past stopped vehicles at 15 mph or less when it is safe. It is never allowed on an on-ramp, and on surface streets the posted limit must be 45 mph or lower.
Does going without a helmet hurt my case?
It should not. Utah Code § 41-6a-1505(6) provides that failing to wear a helmet is not comparative negligence and cannot be introduced as evidence of negligence, injuries or mitigation in civil litigation.
How much does it cost to hire a lawyer after a motorcycle crash?
You pay nothing up front, and no attorney fees unless we win. Our fee is a percentage of what is recovered, and the written agreement spells out how case costs are handled.
How long do I have if a pothole or broken signal caused my crash?
A written notice of claim to the responsible government entity is due within one year. In Millcreek that may be the city, Salt Lake County or UDOT, depending on the road, so identifying the owner quickly is essential.
