Millcreek Slip and Fall Lawyer

Hurt in a fall at Millcreek Common, an apartment complex off 3300 South, a shop on 3900 South or an icy bench walkway? The party responsible for that property may owe you compensation. Free consultation. You pay nothing up front, and no attorney fees unless we win.

Millcreek only became a city in December 2016, and its built environment is older than the city itself: post-war strip retail along 3300 South and 3900 South, apartment courtyards behind those frontages, and a bench of steep residential streets running up toward Mount Olympus. Add a genuine winter microclimate on the east side, where north-facing walks and driveways in Canyon Rim and Olympus Cove hold ice for days after the valley floor has cleared, and most Millcreek fall claims come down to either aging concrete or untreated ice.

A complaint to city code enforcement does not decide who pays for your injury, but a record of earlier complaints about the same property helps show the owner already knew a walk was being left icy or a surface was breaking up. It is worth asking whether one exists before an insurer tells you the hazard appeared that morning.

Making a Millcreek Fall Claim

A fall rarely generates a police report, so the file is built from scratch. Three things have to line up: a genuinely dangerous condition, an owner or manager who knew about it or should have, and proof that the condition is what put you on the ground.

On a shared commercial property the landlord, the individual tenant and a snow-removal or maintenance contractor may each control different surfaces, so exactly where you fell matters. Note the business name or the nearest entrance, ask for an incident report, and send a written request that any video be kept before it is overwritten.

How Utah Defines an Owner's Duty

How much the property owner owed you depends on why you were there:

  • Customers and residents are entitled to routine inspection, and to hazards being fixed or plainly flagged.
  • Social guests are entitled to warning about dangers the host already knows about.
  • Trespassers are owed considerably less.

Insurers lean on the argument that the hazard was obvious. It is not the end of a claim. Where an owner could expect people to use that entrance or walkway anyway, the obligation to address it does not disappear because the danger was visible.

Fault gets apportioned. Utah Code § 78B-5-818 lets you recover only where the defendants' combined fault exceeds your own, and it trims the award by your percentage. In Millcreek cases the questions tend to be about footwear, whether your hands were full, and whether you were moving quickly to catch a bus on 3300 South.

Time limits, and they differ by owner. Most claims against private owners must be filed within four years. A fall on Millcreek city property — city sidewalks, City Hall, or Millcreek Common itself — or on Salt Lake County property requires a written notice of claim within one year (§ 63G-7-402). A fall on national forest land in Mill Creek Canyon runs against the federal government instead, under a different procedure again. Working out who owns the ground you fell on is the first job, not a detail. Our statute of limitations page explains each deadline.

Where Millcreek Falls Happen

Millcreek Common at 1354 East Chambers Avenue, the city's own gathering place between Highland Drive and 1300 East. Its outdoor loop is skated in summer and frozen in winter, and there is a climbing wall, a splash pad and an indoor public market, with a second construction phase under way since 2025. Because the city owns it, a fall there carries the one-year notice deadline rather than four years.

The St. Mark's Hospital campus on 3900 South and the medical offices around it, where patients and visitors who may already be unsteady walk long distances through garages and across plazas. A fall there is a claim against a private owner, with the ordinary four-year deadline.

Mill Creek Canyon's picnic grounds, trailhead parking and the fee station area, which are national forest ground run with Salt Lake County, not city property, and which ice over well before the streets below do. Hazards Behind Millcreek Falls

Cracked and lifted concrete in older lots, worn stair treads, apartment stairwells that funnel meltwater and refreeze overnight, sloped bench driveways cleared to bare ice, entry mats that curl at the edges, poor lighting behind strip centers, and roof leaks that leave standing water inside shops.

Common Injuries

Falls often cause wrist, ankle and hip fractures, shoulder tears, spinal injuries and concussions. St. Mark's Hospital at 1200 East 3900 South in Millcreek is a Level II trauma center, so serious fall injuries are often treated within the city.

Recoverable Losses

  • Bills and income: emergency and surgical charges, rehabilitation, prescriptions, and the shifts you could not work.
  • Personal harm: pain, the narrowing of daily life, and the grind of a long recovery.
  • Future needs: continuing treatment and reduced earning power where an injury does not resolve.

Arguments the Owner's Insurer Makes

Expect claims that the spill was new, that a contractor controlled the area, that the ice was an obvious winter condition, or that you were not looking where you walked. Sweep and salting logs, video, National Weather Service records for the day and a written incident report push back, and on the bench the weather record often shows a thaw and refreeze the owner should have planned for. A Millcreek fall lawsuit is filed in Third District Court for Salt Lake County, at the Matheson Courthouse, 450 South State Street. Common Questions

Millcreek Fall Questions

I fell at Millcreek Common. Who is responsible?

Millcreek Common is city property, so a claim there is against the city and a written notice of claim is due within one year rather than the usual four. If you fell inside a business leasing space in the market, the tenant may be responsible instead. Because the deadline is so much shorter, work out which it is early.

I slipped in a Mill Creek Canyon parking area. What deadline applies?

That ground is national forest, administered by the Uinta-Wasatch-Cache with Salt Lake County operating the fee station, so the claim runs against a government body rather than a private owner and follows a different, shorter procedure. Do not assume the four-year limit that applies to most private claims.

Does being partly careless end my claim?

No. Section 78B-5-818 reduces your award by your share rather than barring it, and you recover as long as the defendants' combined fault is greater than yours.

How are your fees paid?

You pay nothing up front, and no attorney fees unless we win. The fee comes out of the recovery, and the written agreement sets out how case costs are treated.

I fell in a hospital parking garage. Is that a claim?

It can be. A garage or walkway has to be kept reasonably safe for patients and visitors, and that includes ice and spills. Report it before you leave, and photograph the spot before anyone cleans or salts it.

What should I do first after a fall in Millcreek?

Get checked by a doctor, report the fall in writing to the business or property manager, photograph the hazard and your shoes before anything is salted or cleaned, note the temperature and conditions, and collect witness names and phone numbers.
