Herriman Truck Accident Lawyer

Hurt in a collision with a dump truck, a cement mixer or a semi on Mountain View Corridor, Bangerter Highway or Porter Rockwell Boulevard? Our legal team will look at it for free. You pay nothing up front, and no attorney fees unless we win.

Why Heavy Trucks Are Everywhere in Herriman

The census counted 21,785 people in Herriman in 2010 and 55,144 in 2020, and construction has not slowed since. Each new subdivision, school and retail pad brings months of gravel haulers, cement mixers, lumber flatbeds and lowboys carrying excavators, often on streets where families already live. Through-freight adds to it on the state highways that cross and border the city. So the truck traffic here looks different from an older suburb’s: fewer long-haul rigs on residential blocks, and far more work vehicles run by small contractors whose insurance and safety records vary widely.

Mountain View Corridor (SR-85)

UDOT’s records from January 2018 through August 4, 2025 put 484 crashes on this road inside Herriman, more than on any other, with 26 serious or fatal and 4 deaths, as tallied on our Herriman most dangerous roads page. A loaded hauler pulling out from a new cross street needs a long gap to reach speed, and drivers closing fast from behind do not always leave one.

Porter Rockwell Boulevard and Camp Williams Road

On the south end of the city, Porter Rockwell Boulevard (15900 South, SR-131) logged 88 crashes in the same records, and its busiest junctions were Camp Williams Road with 37 and Mountain View Corridor with 30. A tractor-trailer making a right turn at a junction like that has to swing out first, and a car that slips into the gap on its right can be caught as the trailer tracks inward.

U-111 on the northwest edge

UDOT is rebuilding U-111, the old Bacchus Highway, through South Jordan and Herriman. Herriman City announced in September 2026 that a new section had opened to drivers while work went on, and warned motorists to watch for crews and equipment. A work-zone crash with a construction truck can bring in the contractor, and because the project is UDOT’s, the one-year government notice rule as well.

Herriman Highway (13100 South)

This road had just 42 crashes in UDOT’s records, yet 3 were fatal. Unified Fire Authority Station 103 sits on it at 5916 West 13100 South. A collision with a fire engine or any other publicly owned vehicle carries the same short notice deadline as a crash with a city truck.

Streets still under construction

Inside new neighborhoods the danger moves slowly but never stops: a dump truck reversing onto a lot without a spotter, a mixer idling half in the travel lane, mud and rock tracked across fresh asphalt, a bobtail turning off a street that has no sidewalk yet. Kids on foot and on bikes are often the ones in the way. If a walker was hit, our Herriman pedestrian accident page covers that claim.

Police reports, tickets and public defendants

On city streets, officers from the Herriman Police Department at 5355 West Main Street investigate and write the report; on a state highway the Utah Highway Patrol may be the agency instead. A citation is handled by the Herriman City Justice Court, upstairs at City Hall, and that case is separate from your claim against the trucking company. If a city vehicle, a UDOT project, a fire apparatus or any other public body played a part, the Governmental Immunity Act bars the claim unless written notice is filed within one year (Utah Code § 63G-7-402).

Paying for Treatment While Fault Gets Sorted Out

The first money comes from your own auto policy. Personal injury protection pays at least $3,000 of reasonable medical expenses, plus the lesser of $250 a week or 85% of lost gross income for up to 52 weeks, whoever caused the wreck (Utah Code § 31A-22-307). Our explainer on Utah’s no-fault system has the details.

A truck crash can use that up with the ambulance ride and the first scans. Before you can claim general damages such as pain and lost enjoyment of life from the truck’s insurer, § 31A-22-309 asks for at least one of these:

  • Medical expenses above $3,000.
  • A broken bone.
  • Permanent disability or impairment shown by objective findings.
  • Permanent disfigurement.
  • Loss of a limb or other dismemberment.
  • A death.

Clear that bar and the trucking company’s liability policy is answerable for the whole loss, future surgery and reduced earning capacity included. A local hauler that only operates inside Utah may not carry what an interstate carrier must, so the limits need to be confirmed early. If the truck’s coverage runs out, your own underinsured motorist coverage may help, as our underinsured motorist guide explains.

Fault When a Truck Is Involved

Utah weighs fault instead of ending a claim over it. Section 78B-5-818 lets you recover from defendants whose combined fault exceeds yours, and whatever percentage is assigned to you is subtracted from the award.

Expect the usual lines in a Herriman truck case: you sat in the blind spot, you tried to get around a turning mixer, you followed a gravel truck too closely to avoid the rock it dropped. The rebuttal tends to come from the truck’s own cameras and telematics, dispatch records showing where it was sent and when, doorbell video from houses on subdivision streets, and the condition of the load and its cover.

Filing deadlines

An injury suit from a vehicle crash generally has to be filed within four years (§ 78B-2-307), and a family’s wrongful death action within two (§ 78B-2-304). Herriman City, UDOT and other public bodies must receive written notice within one year. Our Utah statute of limitations guide lists the exceptions.

Federal Trucking Rules That Matter Here

Driver logs and the six-month clock

A motor carrier only has to keep each driver’s records of duty status and the documents supporting them for six months (49 CFR 395.8(k)). After that they can be thrown out lawfully, and an hours-of-service violation gets much harder to prove. A preservation letter sent early stops them from disappearing in the normal course of business.

Reading the cab door

A commercial truck covered by the federal rules has to show the operating carrier’s name and USDOT number on both sides, readable from 50 feet in daylight (49 CFR 390.21). Around a building site the truck may belong to a subcontractor rather than the builder named on the lot sign, which is why one photo of the door can decide who gets sued.

Coverage floors for interstate carriers

A for-hire carrier hauling ordinary freight across state lines in a truck rated at 10,001 pounds or more has to carry at least $750,000 in public liability coverage, and some hazardous cargo requires as much as $5,000,000 (49 CFR 387.9). Our Utah truck accident claims guide walks through how those layers fit together.

Several companies, several policies

A construction crash in Herriman often involves a chain of businesses: the developer, the general contractor, the subcontractor who booked the hauling, and the hauler. Each may carry its own insurance, and responsibility can follow whoever controlled the driver or the site. Untangling that is part of the first weeks of work, not something to leave for later.

Spilled loads and trucks that keep going

Rock flying off an uncovered load and a truck that never stops are both familiar Herriman complaints. A vehicle that leaves the scene and is never identified is treated as uninsured, so your own uninsured motorist coverage may respond (§ 31A-22-305). If it never touched you or your car, that statute requires clear and convincing proof of the truck’s existence beyond your own testimony, so dashcam footage or a witness matters a great deal.

First Steps After a Herriman Truck Crash

  • Call 911, find out whether Herriman Police or the Highway Patrol is taking the report, and write down the case number.
  • See a doctor that day. Intermountain Riverton Hospital at 3741 West 12600 South is designated Level IV, meaning it stabilizes and transfers; major trauma goes to the Level I center at Intermountain Medical Center in Murray.
  • Photograph the door markings and USDOT number, the plate, any company name on the trailer or the load, and the lot or job site the truck came from.
  • Collect witness names, and note any construction cameras, doorbells or dashcams that might have caught it.
  • Open your PIP claim, and send the trucking company’s adjuster to our legal team instead of giving a recorded statement.

If a Herriman truck case has to be filed, it belongs in the Third Judicial District Court for Salt Lake County, with courthouses in West Jordan (8080 South Redwood Road) and downtown Salt Lake City (450 South State Street). Most claims settle long before trial, but the carrier’s records should be locked down with a preservation letter right away. Call (801) 921-5134 or request a free case review. Free consultation.
