Cedar City Dog Bite Lawyer

Bitten by a dog in Cedar City? Utah makes the owner responsible. Free case review, and no attorney fees unless we win. Hablamos Español.

Most dog bites in Cedar City happen close to home: a neighbor's dog that gets through a gate, a dog loose in an apartment complex near campus, a dog met on a walk in a city park or along the Coal Creek Trail, or a visit or delivery to a house where the dog was not put away. Children can be bitten by a dog they have played with many times.

Few people want to sue a neighbor or a landlord. In practice, a Utah dog bite claim is usually paid by the owner's homeowner's or renter's insurance rather than out of anyone's pocket, which makes the decision easier for many families.

Utah's Dog Bite Rule

Owners and keepers are responsible. Under Utah Code § 18-1-1, anyone who owns or keeps a dog is liable for injuries it causes, regardless of whether the dog was vicious or the owner knew it. Utah has no one-bite rule.

A few exceptions. The statute excludes certified police dogs used under a written agency policy, injuries to another animal that entered the owner's property without consent while the dog was fenced in, and trespassers on the owner's private property while the dog was secured in a fence or enclosure.

Shared fault is possible. Damages are decided under Utah's comparative fault statute, § 78B-5-818, which is where insurers raise provocation. Our damages page explains what a claim can include.

More time for children. The statute of limitations does not run while an injured person is under 18 (§ 78B-2-108). Adults generally have four years; see our deadlines page.

Cedar City's Own Animal Rules

Chapter 11 of the Cedar City Code, the city's animal control ordinance, makes it unlawful to let an animal run at large, which includes leaving its residential property unrestrained outside a park that allows unleashed animals, and holds the owner strictly liable for that violation (§ 11-V-2). It also makes it unlawful for an owner to allow an animal to attack, bite or chase a person (§ 11-VI-1). A city citation is not the same as a civil claim, but it can help show how the bite happened.

The ordinance requires a dog's owner to report a bite immediately to the city's animal control division (§ 11-III-1), and a domestic animal that bites a person with an exchange of bodily fluids must be confined for observation for at least 10 days (§ 11-III-2). Cedar City Animal Control is a division of the police department, located at 1303 West Kittyhawk Drive.

Get the wound cleaned and checked the same day, because bites can become infected; Cedar City Hospital on North Main Street has a 24-hour emergency department. Photograph the wounds as they heal, and write down the owner's name and address and any homeowner's or renter's insurer. If the dog belonged to a tenant, the landlord or property manager may matter too, especially where a fence, gate or common area was in poor repair. More on value is in our guides to dog bite compensation and dog bite settlements.

Injuries From Dog Attacks

Puncture wounds and tears that need stitches or plastic surgery, facial scarring, nerve and tendon damage to hands and arms, infections, fractures from being knocked down, and a lasting fear of dogs, especially in children.

What a Claim Covers

A full dog bite claim should account for:

  • Medical care: the emergency visit, antibiotics, wound care and follow-up appointments.
  • Scar treatment: revision or reconstruction, including procedures a child may need while growing up.
  • Lost income: your own missed work, or a parent's time off to care for a child.
  • Pain and emotional harm: the physical injury and the anxiety that follows it.
  • Disfigurement: permanent scars, especially on the face or hands.

How the Insurer Responds

Expect the insurer to argue that you provoked the dog, came onto the property uninvited, or that the scar will fade, and to make an offer before treatment and any scar revision are finished. Photographs taken over time and a surgeon's opinion about future care usually carry the most weight. Cedar City Dog Bite Questions

What People Ask After a Dog Bite

The dog had never bitten anyone before. Is the owner still liable?

Yes. Under Utah law the owner or keeper is responsible whether or not the dog had shown any sign of being dangerous.

The dog belongs to my neighbor. Will they pay out of pocket?

Usually not. Most of these claims are paid by the owner's homeowner's or renter's insurance.

My child was bitten. What is the deadline?

The statute of limitations does not run while a child is under 18, but evidence and witnesses fade, so it is still wise to act early.

The owner claims I provoked the dog. Does that end my case?

No. Fault can be shared under Utah's comparative fault law, which may reduce a recovery if provocation is shown, but it does not automatically defeat the claim.

What does it cost to hire you?

The consultation is free, and there are no attorney fees unless we win.

Does Cedar City require the dog to be quarantined?

Under the city's animal control ordinance, a domestic animal that bites a person with an exchange of bodily fluids must be kept in strict confinement for observation for at least 10 days from the date of the bite.
