Draper Rideshare Accident Lawyer

Draper is where a lot of the south valley's trips change hands. Two TRAX Blue Line stations sit inside the city, Draper Town Center at 1131 East Pioneer Road and Kimballs Lane at 11796 South 700 East, and FrontRunner stops at 12997 South FrontRunner Boulevard. Plenty of riders cover the last stretch from those platforms in an Uber or Lyft. Others ride over the Point of the Mountain on I-15 toward the Lehi office parks, or head home from dinner along 12300 South, the Draper street with the most crashes off the freeway: 897 from January 2018 through August 4, 2025, in the UDOT records tallied on our Draper most dangerous roads page.

Few of those pickup points were designed for stopping. A driver eases to a curb never meant for waiting, glances down for the next request, and pulls back into traffic moving fast a short distance away. After a crash there, the useful first question is what the driver's app was showing at that second, because Utah sets the required rideshare insurance by that status.

The App Screen Sets the Insurance Floor

Under Utah Code § 13-51-108, minimum coverage follows the driver's status, using the phases defined in § 13-51-102. For a trip out of a Draper station, it breaks down this way:

  • Logged out. No rideshare coverage is required, and the claim begins with the driver's personal auto policy. Because Utah lets a personal insurer exclude rideshare driving (§ 13-51-108(11)), the minute the driver actually logged off is often contested: each insurer would rather the crash fall on the other side of that line.
  • Logged in, no request accepted. The statute calls this the waiting period. Required liability limits are $50,000 for one injured person, $100,000 for everyone injured, and $30,000 for property damage, with PIP and the uninsured and underinsured motorist coverage Utah law calls for.
  • Request accepted until the rider exits. This is the prearranged ride (§ 13-51-102). The policy must apply on a primary basis and carry at least $1,000,000 in liability coverage per occurrence, again with PIP and uninsured and underinsured motorist coverage.

A driver parked near the Draper Town Center platform can move from waiting to an accepted trip with one tap, and the required minimum climbs from tens of thousands of dollars to a million on that tap. We do not rely on an adjuster's account of the timing. We ask the company for the acceptance time, the trip record and the GPS trail, then line them up with the police report and your receipt. Four Draper Trips That Can Lead to a Claim

The coverage reaches beyond the back seat. Each of these people may have a claim:

  • A passenger picked up at the FrontRunner lot or the Kimballs Lane platform and hurt on the way home.
  • A motorist hit by a rideshare car merging off Bangerter Highway or turning across 12300 South.
  • A pedestrian walking to a train, or crossing a parking area, when a driver swung in to meet a fare.
  • The rideshare driver, when another motorist caused the crash while the app was on.

Utah Rules in Brief

Your own PIP pays the first medical bills, at least $3,000, no matter who was at fault (§ 31A-22-307; see how Utah's no-fault system works), and a claim for pain and other general damages opens once an injury clears a threshold such as a broken bone or more than $3,000 in medical expenses (§ 31A-22-309). Under § 78B-5-818 your share of fault reduces the award, and you recover nothing unless the combined fault of the others exceeds yours. Most injury suits must be filed within four years (§ 78B-2-307), but a claim against UTA, Draper City, Salt Lake County or UDOT needs a written notice of claim within one year (§ 63G-7-402); our Utah deadlines page has the details.

Crossing the Point: Police, Courts and Hospitals

Inside city limits, crashes are handled by the Draper City Police Department at 1020 East Pioneer Road, which takes report requests through the city's online records portal; on I-15 the Utah Highway Patrol usually responds. A ride that crashes just south of the county line, on the Utah County side of the Point of the Mountain, falls to different agencies, so the first step is confirming who wrote the report. A ticket issued in Draper goes to the Draper City Justice Court, on the lower level of City Hall at the same Pioneer Road address, which handles infractions and misdemeanors from inside the city; it decides the citation, not the injury claim. Ambulance crews come from the Draper City Fire Department, which operates three stations, including Station 21 at 780 East 12300 South. Lone Peak Hospital on State Street is the city's local emergency department, and the closest Level I trauma center on the state's list is Intermountain Medical Center in Murray. What Draper Riders and Drivers Ask Us

I took a Lyft home from the Draper FrontRunner station and the driver ran a red light. Who pays?

You were on a prearranged ride, so the driver's rideshare coverage of at least $1,000,000 per occurrence applies, along with PIP and uninsured and underinsured motorist coverage. If a second driver shares the blame, that driver's insurer is part of the claim too.

Can Draper City make its own rules for Uber and Lyft?

Not for the companies, their drivers or their services. Utah Code § 13-51-109 sets aside city and county regulation of rideshare, keeping only local rules at airports, so a Draper crash is measured against the same state coverage law as one in Logan or St. George.

The driver's personal insurer denied my claim. Is that the end of it?

No. Utah lets a personal auto insurer exclude rideshare driving (§ 13-51-108(11)), but the rideshare policy cannot be written to wait for that denial before it responds (§ 13-51-108(10)), and if a driver's own rideshare coverage has lapsed, the company must provide coverage from the first dollar (§ 13-51-108(9)).
