Kearns Pedestrian Accident Lawyer

Plenty of Kearns residents get around on foot. Students walk to Kearns High School at 5525 South Cougar Lane, runners head to the 442-meter track inside the Utah Olympic Oval at 5662 South on the same street, and riders wait along 5400 South for UTA Route 54, which runs between West Kearns and Murray Central Station. Many of those trips cross or follow a state highway, since 5400 South, 5415 South and 5600 West are UDOT routes rather than city streets.
Kearns became a city on May 1, 2024, yet it still relies on the Unified Police Department for patrol and on the Greater Salt Lake Municipal Services District for municipal services. For someone hit on foot, two patterns in the UDOT crash records matter more than that history: a large share of Kearns crashes happen after dark, and drivers here leave the scene unusually often.
When the Driver Does Not Stop
Our Kearns most dangerous roads study found that drivers left the scene in 18.5% of the crashes on Kearns streets from January 2018 through August 4, 2025, the highest hit-and-run rate among the 57 Utah cities with enough crash data for that analysis. Being hit by one of those drivers does not leave you without a claim. Utah law treats an unidentified vehicle that left the scene of a crash its driver caused as an uninsured motor vehicle (§ 31A-22-305(2)(b)), which lets the uninsured motorist coverage on your own household’s policy step in.
Two details shape those claims. If the car never actually touched you, say a driver who forced you to jump back from the curb, the statute demands clear and convincing proof of that vehicle that goes beyond your own testimony (§ 31A-22-305(6)), so a witness’s phone number or a camera clip carries real weight. And the injury threshold that limits other auto claims does not apply to an uninsured motorist claim (§ 31A-22-309(1)(b)). Call 911 from the scene so an official record exists. Coverage That Pays First
For a pedestrian hurt in Kearns, the insurance usually comes into play in this order:
- Personal injury protection. PIP on your own household’s auto policy follows you when a vehicle strikes you on foot, and if nobody in your household carries a policy, the PIP on the car that hit you can cover a pedestrian injured in Utah (§ 31A-22-308). It pays regardless of fault: at least $3,000 in medical expenses and the lesser of $250 a week or 85% of lost gross income for up to 52 weeks (§ 31A-22-307). - A claim against the driver. To recover pain, suffering and other general damages from the driver, your injury generally has to meet one of the conditions in § 31A-22-309(1)(a): a bone fracture, permanent disability or impairment shown by objective findings, permanent disfigurement, dismemberment, death, or medical expenses above $3,000.
Liability coverage is often thin. A Utah auto policy issued or renewed on or after January 1, 2025 must carry only $30,000 of bodily injury coverage per person (§ 31A-22-304), and a single hospital admission can use that up. When it runs out, underinsured motorist coverage on your own policy may fill part of the gap.
Crossing Rules That Decide Fault
Drivers have to yield, slowing or stopping as needed, to anyone inside a crosswalk who is on their half of the roadway or approaching from the opposite half so closely as to be in danger, and nobody may overtake a vehicle that has stopped to let a pedestrian cross (§ 41-6a-1002). At an occupied school crosswalk, that section requires a full stop. Pedestrians have duties too: away from a marked crosswalk or an unmarked one at an intersection, they must yield, and between two neighboring signalized intersections they may cross only in a marked crosswalk (§ 41-6a-1003). Breaking one of those rules does not end a case. Utah cuts your damages by your percentage of fault and stops recovery only once that share reaches 50% (§ 78B-5-818). Cougar Lane, 5400 South and 4015 West
Cougar Lane (4800 West) runs past both Kearns High and the Olympic Oval. Our study counted 260 crashes on it from January 2018 through August 4, 2025, and a teen driver was involved in 90 (34.6%); its busiest junctions were 5400 South (57), 5415 South (40) and Kearns High Drive (34). 5400 South (SR-173) had 285 crashes, 8 of them serious or fatal, and a pedestrian was involved in 3 of the serious ones. 4015 West had 233 crashes and 6 serious or fatal ones, and pedestrians were involved in 3 of those 6. Citywide, pedestrians were in 2.1% of crashes but 17 of the 96 serious or fatal ones.
Unified Police officers from the Kearns Precinct, 4250 West 5415 South, generally take the report, and Unified Fire Authority Station 109 operates a short way west at 4444 West 5415 South. A traffic citation issued to the driver is heard in the Salt Lake County Justice Court at 2001 South State Street, whose jurisdiction includes Kearns. Your injury claim is a separate civil case; if it is filed, it goes to the Third Judicial District Court, which sits at the Matheson Courthouse, 450 South State Street, and at 8080 South Redwood Road in West Jordan.
Deadlines That Apply in Kearns
Most injury suits must be filed within four years (§ 78B-2-307), and a wrongful death action within two (§ 78B-2-304). The deadline that catches families off guard is shorter. If a malfunctioning pedestrian signal, a hazard on a state route or a government vehicle played a part, a written notice of claim must be filed with the responsible entity within one year (§ 63G-7-402), and in Kearns that could be UDOT, the City of Kearns, Salt Lake County or UTA. Holy Cross Hospital – West Valley, at 3460 South 4155 West in West Valley City, appears on the Utah Bureau of EMS trauma-center list as Level III. Intermountain Medical Center in Murray and University Hospital in Salt Lake City are Level I centers. Pedestrians hit at arterial speed often arrive with leg and pelvic fractures from the bumper, head injuries from the hood, windshield or pavement, and wrist or shoulder fractures from the fall.

Often, yes. Utah treats an unidentified vehicle that left the scene as uninsured, so your own uninsured motorist coverage may pay, and if your household has auto insurance, its PIP still covers early medical bills. Report the crash to police right away.
