West Valley City Slip and Fall Lawyer

Hurt in a fall at a West Valley City store, apartment complex or parking lot? If the owner's hazard caused it, you may have a claim. Free consultation, and no attorney fees unless we win.

West Valley City tells property owners to clear the sidewalks in front of their homes within 24 hours of a storm (West Valley City snow removal). Many winter falls still start the same way: a walk that was never shoveled, or a big retail lot along 3500 South or Redwood Road that was plowed but not salted, leaving packed ice between the car and the door.

Other falls happen indoors: a spill in a grocery aisle, meltwater inside a mall entrance on a storm day, a broken stair in an apartment building, or a crowded concourse after an event. Every one of these cases depends on proving the condition before it is cleaned, repaired or buried under new snow.

The Elements of a Fall Claim

A fall rarely produces a police report. You have to show that a dangerous condition existed, that the owner or occupier created it, knew about it, or would have found it with reasonable inspection, and that it caused your injury.

Useful proof includes photos of the exact spot and of your shoes, witness names, a copy of the store's or manager's incident report, a receipt or card record showing when you were there, and security video, which many businesses record over within days or weeks.

Duties of Property Owners in Utah

Utah scales an owner's duty to the reason you were on the property:

  • Invitees, such as customers, tenants in common areas and ticket holders, are owed reasonable inspection and repair, or a warning.
  • Licensees, such as social guests, are owed a warning about hidden dangers the owner knows about.
  • Trespassers are owed only a limited duty.

Owners like to say a hazard was open and obvious. That argument can reduce a recovery, but it does not end a claim when the owner should have expected people to be hurt by the hazard anyway.

Your share of fault. Under Utah Code § 78B-5-818, you recover only if the owner's fault is greater than yours, and your award is reduced by your percentage. Expect questions about footwear, lighting and your phone.

Time limits. Four years is the usual limit for a fall claim. If you fell on a city sidewalk, at a city or county building, at a TRAX station or on other public property, a written notice of claim is due within one year (§ 63G-7-402). Every deadline is on our statute of limitations page.

Where West Valley City Falls Happen

Retail along 3500 South, including Valley Fair Mall and the strip centers between Bangerter Highway and Redwood Road, where entrances collect meltwater and big parking lots refreeze overnight.

Event venues such as the Maverik Center at 3200 South Decker Lake Drive, where crowds leave by stairs and ramps into large lots after dark.

Apartment complexes and the West Valley Central TRAX station at 2750 West 3590 South, where snow and ice removal may belong to a landlord, a management company or a public agency, and a public owner brings in the one-year notice.

Hazards We See

Ice left on walks well after a storm, refrozen melt below downspouts, unmarked wet floors, produce and liquid spills, uneven sidewalk slabs and parking-lot potholes, broken or missing handrails, dark stairwells, and curled mats at store entrances.

Fall Injuries

Hip and wrist fractures, broken ankles, torn knee and shoulder ligaments, back injuries, and concussions from striking the ground. Holy Cross Hospital – West Valley on Pioneer Parkway has an emergency department, and the most serious injuries are often sent to a Level I trauma center such as Intermountain Medical Center in Murray.

Compensation After a Fall

  • Financial losses: emergency care, surgery, physical therapy, future treatment, lost pay and lost earning capacity.
  • Personal losses: pain, limits on daily life and the things you can no longer do. Our damages page explains each category.
  • Care and help at home when the injury leaves a lasting limitation.

How Property Insurers Defend These Claims

The usual defenses are that you should have seen the hazard, that the ice formed moments before you fell, or that your shoes were to blame. Weather data for that day, the property's snow-removal and cleaning logs, and prompt photos answer them. Our Utah slip and fall guide goes deeper, and the steps in a Utah injury case explain what follows. If you were hurt in a parking-lot collision instead, see our West Valley City car accident page; other injuries are covered on our West Valley City personal injury page.

Common Questions

West Valley City Fall Questions

I slipped in a store parking lot on 3500 South. Do I have a case?

It depends on whether the store knew or should have known about the ice and had a fair chance to treat it. Weather records, photos and the store's maintenance records usually decide it.

The manager said the spill was obvious. Is that the end of it?

No. Whether a hazard was obvious is one factor. It can lower a recovery, but it does not decide the case on its own.

Can I recover if I was partly to blame?

Yes, if the owner's fault is greater than yours. Your award is reduced by your share under Utah Code § 78B-5-818.

What does it cost to hire you?

The consultation is free. You pay nothing up front, and no attorney fees unless we win.

I fell at a TRAX station. Is the deadline different?

Yes. UTA is a government entity, so a notice of claim is due within one year, well before the usual four-year limit.

What should I do right after I fall?

Get medical care, tell the manager or landlord and ask for a copy of the report, photograph the hazard and your shoes, and collect witness names.
