Holladay Dog Bite Lawyer
Bitten by a dog in Holladay? Utah makes the owner or keeper responsible from the very first bite. Free case review, and no attorney fees unless we win. Hablamos Español.
Holladay bites tend to happen where people live rather than where they shop. The city is largely residential, built on deep lots behind fences, gates and mature hedges, and that is precisely the setting for the two patterns we see most: a dog that gets through a gate left open, and a dog loose in the yard when a delivery driver, meter reader or contractor walks up the drive. The rest cluster around the parks, Knudsen Park at historic Knudsen's Corner in the southeast of the city and the Holladay Lions area of Big Cottonwood Regional Park, where a dog off leash is already outside the city rules.
Almost nobody wants to sue a neighbor or a landlord. What most people do not know at the outset is that a Utah dog bite claim is normally paid by the owner's homeowner's or renter's policy rather than out of the owner's own pocket, and knowing that usually makes the decision easier to live with.
Utah's Dog Bite Statute
Utah Code § 18-1-1 places liability on whoever owns or keeps the dog, with no need to show the animal had bitten before or that the owner should have known. Utah gives no free first bite. Our guide to tenant and landlord liability covers who else can be named.
The exceptions are narrow: certified police dogs working within agency policy, injuries to another animal that wandered onto the owner's fenced property, and certain trespassers hurt while the dog was reasonably secured.
Shared fault still applies. The statute routes damages through Utah's comparative fault rule, § 78B-5-818, which is where provocation arguments enter. Our damages page sets out what can be recovered.
Children get more time. The limitations clock does not run while the injured person is under 18 (§ 78B-2-108), while adults generally have four years. See our deadlines page.
After a Dog Bite in Holladay
Have the wound cleaned and examined the same day; Intermountain Medical Center in neighboring Murray is the closest Level I trauma center for a severe injury. Then report it, because the bite report is the single most important piece of evidence in most of these cases. Animal control for Holladay is provided by Salt Lake County Animal Services, whose 24-hour officer dispatch line is (801) 840-4000; the main office line is 385-468-7387. County rules require the owner and the bitten person to report a bite within 24 hours. Reporting opens an official file, allows the dog's vaccination status to be checked, and records the owner's identity before anyone's memory changes. Photograph the wounds as they heal, and write down the owner's name, address and insurer.
Where the dog lives with a tenant, the landlord or property manager can belong on the claim as well — a broken gate, a gap in a fence, or a shared courtyard at one of the apartment communities along Murray-Holladay Road.
For how these claims are valued, see our guides on dog bite compensation and typical dog bite settlements.
Common Dog Bite Injuries
Deep punctures and tears needing stitches or plastic surgery, facial scarring, nerve and tendon damage through the hand and forearm, infection, fractures from being pulled or knocked down, and a lasting fear of dogs that shows up most often in children.
What a Claim Can Include
A complete claim should account for:
- Medical treatment, from the emergency visit and antibiotics through wound care and every follow-up.
- Scar treatment, including revision surgery and the reconstruction a child may need years later as they grow.
- Lost income — your own missed work, or the time a parent takes off to care for an injured child.
- Pain and fear: the injury itself and the anxiety that outlasts it.
- Disfigurement: permanent scarring, above all on the face or hands.
How Insurers Respond
The familiar defenses: you provoked the dog, you were on the property uninvited, the scar will fade with time. Early offers tend to arrive before the wound has finished healing or a surgeon has said anything about revision. Photographs taken across several weeks and a written opinion on future care are the strongest answer to all three. Our Holladay personal injury page covers other injuries in the city, and the Holladay car accident page covers crashes.

What People Ask After a Dog Bite in Holladay
The dog never bit anyone before. Is the owner still liable?
Yes. Section 18-1-1 does not ask whether the dog was known to be dangerous. Owning or keeping it is enough.
It was a neighbor's dog. Will they pay out of pocket?
Usually not. These claims are ordinarily paid through the owner's homeowner's or renter's insurance.
My child was bitten. How long do we have?
Utah's clock does not run while a child is under 18, but the bite report, the photographs, the witnesses and the dog's vaccination record are all far easier to secure now than later. Holladay contracts its animal control to Salt Lake County Animal Services — call them and get a report number before anything else.
The owner says I provoked the dog. Is my claim over?
No. Provocation is something the owner's side has to prove, and Utah's comparative fault rule apportions responsibility rather than ending a claim. Our guide to proving fault explains how that allocation works.
What does it cost to hire you?
The consultation is free. You pay nothing up front, and no attorney fees unless we win.
Does it matter that the dog was off leash in a Holladay park?
It can. Holladay City Code requires any animal in a city park to be leashed on no more than eight feet, strong enough that the handler keeps absolute control at all times, so a loose dog in a Holladay park is already outside the ordinance. Liability under § 18-1-1 does not turn on the leash, but the violation undercuts any claim that the owner had the animal under control. Mill Creek Canyon is the local exception worth knowing: Salt Lake County has allowed dogs off leash there on odd-numbered days since 2001 and required a leash canyon-wide on even days, so the date of the bite changes that conversation.
