Holladay Pedestrian Accident Lawyer

Holladay is a city of roughly 31,000 people on mature, tree-lined streets, and a lot of them walk: to Holladay City Park at 4580 South 2300 East, to Knudsen Park at 6290 South Holladay Boulevard, to the shops and restaurants along Highland Drive, and to Olympus High, Olympus Junior High and Bonneville Junior High. Several of those routes have no continuous sidewalk.

Hedges, parked cars and older street layouts limit what drivers can see, and three I-215 interchanges push freeway traffic onto those same streets. Under § 41-6a-102, an intersection crosswalk exists where the sidewalk lines on opposite sides would connect, measured from the edge of the traversable roadway where there is no curb, and where a street has a sidewalk on only one side, the crosswalk extends straight across from that sidewalk's lines.

Walkers must yield when crossing anywhere else, and may not step from the curb into the path of a car too close to stop (§ 41-6a-1003). Insurance After a Holladay Pedestrian Crash

Utah's modified comparative fault rule (§ 78B-5-818) cuts your damages by your own share and lets you recover only from parties whose combined fault exceeds yours, so an even split means no recovery. Most injury suits have four years. A claim against Holladay City, Salt Lake County, UDOT or UTA needs a written notice within one year (§ 63G-7-402), which can include a claim that public landscaping or a missing sign blocked the view. Holladay contracts with the Unified Police Department for all police services, including a traffic unit, and UPD stations officers at Olympus High, Olympus Junior High and Bonneville Junior High. The Utah Highway Patrol handles I-215. The Holladay Justice Court, currently at a temporary location at 3330 South 1300 East in Millcreek, hears traffic citations; injury lawsuits go to the Third Judicial District Court.

If You Were Hit on Foot in Holladay

The corner where I was hit has no crosswalk paint. Was I in a crosswalk?

Very often yes. Utah Code § 41-6a-102 defines a crosswalk at an intersection by the connection of the sidewalk lines, painted or not, and drivers must yield to pedestrians in it.
