Hit by a semi on I-215 or a delivery truck on Fort Union Boulevard? We review Cottonwood Heights truck cases free. You pay nothing up front, and no attorney fees unless we win.

Where Trucks and Cottonwood Heights Traffic Collide

Cottonwood Heights calls itself the city between the canyons, and that shape sets its truck traffic. I-215 runs the northern border, Fort Union Boulevard carries the commercial load north of the ridge, and resort, construction and utility rigs climb toward Big and Little Cottonwood Canyons along the eastern edge.

I-215 along the northern border

Freight crossing the south end of the valley uses I-215 through the city edge, with ramp traffic feeding it from Union Park Avenue and 6200 South. Merging semis meet commuters braking for ramp queues, and the sideswipes and rear-end crashes that follow happen at highway speed, where the weight difference decides the injuries.

Fort Union Boulevard

The commercial spine north of the ridge, lined with retail driveways and delivery bays. Box trucks stop in or beside the travel lane to unload and swing wide across lanes to reach loading areas. The people hurt are usually the driver alongside a turning trailer or the pedestrian crossing behind one.

Wasatch Boulevard and the canyon approaches

Wasatch Boulevard funnels everything toward the mouths of both canyons. Resort supply trucks, construction and utility rigs and winter traffic on mixed tire equipment share a grade with cyclists and with cars turning across it. Slow heavy vehicles and impatient passing is the pattern that repeats here.

Bengal Boulevard and the streets above the ridge

Bengal Boulevard and the residential grid above the ridge take construction, moving, refuse and delivery trucks through streets built for cars, past schools and around blind curves. Backing trucks and trucks parked across sightlines cause the crashes, and children and drivers pulling out of driveways absorb them.

The canyon roads, SR-190 and SR-210

Big Cottonwood Canyon is SR-190 and Little Cottonwood is SR-210, and both climb straight out of the city's eastern edge. Resort supply trucks, tour buses and shuttle vans work these grades year round. When the beacons flash, UDOT's Class 3 traction restriction applies: at least 5/32 inch of tread, M+S tires on all wheels as the minimum for four-wheel drive, and 3PMSF tires or chains on the drive wheels for two-wheel drive. Cottonwood Heights Police enforce it at the mouth of Big Cottonwood while Sandy Police cover Little Cottonwood. A commercial vehicle that climbed out of compliance and jackknifed on packed snow has a problem that reaches well past the citation.

Which agency responds, and why that matters

Cottonwood Heights runs its own police department. The city council voted in January 2008 to end its Salt Lake County Sheriff contract, and the new force took over that September, so crashes on city streets are its reports. The Utah Highway Patrol generally works I-215. Above the city limits both canyons fall to the Salt Lake County Sheriff's Office Canyon and Unincorporated Patrol, a change from the years when Unified Police covered them. A wreck on SR-210 and a wreck on Fort Union Boulevard therefore land in different agencies' records systems and each has to be requested separately. Where a UDOT work zone, a UTA bus or a city vehicle is involved, the Governmental Immunity Act applies and the claim is barred unless notice is filed within one year (Utah Code § 63G-7-402).

Who Pays for Treatment First

Your own auto insurer pays first through personal injury protection, whoever caused the crash. Utah Code § 31A-22-307 sets a $3,000 medical minimum and pays 85% of lost gross income up to $250 weekly for as long as 52 weeks. Learn how PIP works.

A helicopter evacuation off a canyon grade, or an ambulance down Wasatch Boulevard followed by a trauma workup, can burn through that before the day is out. You reach the trucking company for pain, permanent limitation and lost quality of life only after clearing the Utah Code § 31A-22-309 threshold, which means one of these:

  • Medical bills totaling more than $3,000.
  • A fracture.
  • Permanent disability or impairment supported by objective medical findings.
  • Lasting disfigurement.
  • Dismemberment.
  • Wrongful death.

Past that point the carrier's liability policy answers for the entire loss, including treatment still ahead of you and earning capacity you do not get back. Where the truck's policy runs out, underinsured motorist coverage on your own policy can be stacked on top of it, and if the truck carried nothing at all, an uninsured motorist claim skips the threshold altogether. See how UIM coverage works.

How Utah Splits Fault

Utah Code § 78B-5-818 lets you recover only where the defendants' combined share of fault exceeds your own, and whatever share is assigned to you comes off the top of the award.

In a Cottonwood Heights case the adjuster may argue you passed a slow truck on the canyon grade, merged late onto I-215, or walked behind a backing trailer at a Fort Union loading bay. Business video, the electronic data on the truck and the post-crash testing of the driver usually settle those arguments.

Deadlines to protect your claim

A motor vehicle injury suit generally runs four years (§ 78B-2-307) and a wrongful death claim two (§ 78B-2-304), but anything touching UDOT, UTA, Salt Lake County or Cottonwood Heights City has to be noticed inside one year. Our deadline guide covers the rest.

Federal Trucking Rules That Decide Canyon and Corridor Cases

The four-hour alcohol window

No commercial driver may drink within four hours of going on duty, none may have any measurable alcohol while working, and no carrier may put a driver behind the wheel who appears to have been drinking inside that window (49 CFR 392.5). On resort supply and shuttle runs that finish at a canyon lodge, when the last stop ended is often the entire question.

Drugs and prescriptions that impair

Schedule I drugs, amphetamines, narcotics and anything else that makes driving unsafe are off limits on duty, and a carrier that permits it shares the exposure (49 CFR 392.4). A prescription is an exception only where a medical practitioner said in advance that it would not affect safe operation, which is worth pressing on a driver running long winter shifts.

Reading the carrier off the door

An operating carrier must show its name and USDOT number on both sides of the vehicle, readable at fifty feet, and a leased truck running under another company's name has to add "operated by" with the real carrier's details (49 CFR 390.21). Canyon and resort work is heavily subcontracted, so the name on the door and the name on the insurance policy are frequently different companies. One photograph of the door usually settles which is which.

Hazmat and the higher limits

General freight moving interstate requires at least $750,000 in liability coverage, and hazardous loads require more: $1,000,000 for many of them and $5,000,000 for certain bulk hazardous substances (49 CFR 387.9). The fuel and propane tankers supplying the canyon resorts and the restaurants along Fort Union Boulevard sit in those upper tiers, which changes what a serious case is actually worth. Our Utah truck accident guide goes further.

When the truck does not stop

A truck that causes a crash and keeps going may leave you with an uninsured motorist claim instead. Where nothing actually made contact, Utah Code § 31A-22-305(6) demands clear and convincing proof beyond your own word that the vehicle existed, which in practice means a plate, a door marking, or another driver who watched it happen.

After a Truck Crash Between the Canyons

  • Call 911 and wait for Cottonwood Heights Police, the Utah Highway Patrol on I-215, or the Salt Lake County Sheriff's Canyon Patrol in the canyons; write down the agency and the case number.
  • Get checked the same day. Alta View Hospital is at 9660 South 1300 East in Sandy, and Intermountain Medical Center in Murray is the Level I trauma center for serious injuries.
  • Photograph both doors for the carrier name and USDOT number, any placards, the trailer, and the grade or ramp where it happened.
  • Get names and numbers of witnesses, including drivers stopped behind you in a canyon closure who watched it happen.
  • Open the PIP claim, then let your attorney deal with the carrier's insurer and the rapid response team it sends out.

A Cottonwood Heights truck case that has to be filed goes to the Third Judicial District Court for Salt Lake County, either the Matheson Courthouse at 450 South State Street or the West Jordan courthouse on Redwood Road. Class B and C misdemeanors arising from the same crash are heard in the Holladay Justice Court, which serves Cottonwood Heights by interlocal agreement. Most claims resolve long before a filing, but the carrier should receive a written preservation demand immediately, because electronic logs and dash video cycle out on their own schedule.
