Saratoga Springs writes its leash rule into the definition of control. Under the city's animal code, a dog is not under its owner's control unless it is on a leash or lead, confined in a vehicle, or within the owner's property lines (City Code § 9.01.01). Section 9.01.05 makes it unlawful to let a dog run at large, or to let it onto someone else's private property without permission whether or not it is leashed, and it treats the owner as in violation regardless of the precautions taken to prevent an escape. With 29 city parks, trailheads at Inlet Park and along the Jordan River, and sidewalks shared by children, runners and delivery drivers, those rules come up often.
A broken leash rule is not required for a claim; Utah's dog statute imposes liability either way. But a dog loose in a park or out an open gate is strong evidence of what went wrong, and earlier at-large complaints about the same dog can show the owner knew. Most of these claims are paid by a homeowner's or renter's liability policy rather than out of a neighbor's pocket.
What Utah's Dog Statute Says
Owner or keeper liability. Utah Code § 18-1-1 makes a person who owns or keeps a dog liable for injuries it causes, whether or not the dog was vicious or mischievous and whether or not the owner knew it. Someone caring for a dog, not only its legal owner, can fall within that language.
Limited exceptions. The statute carves out certified police dogs used under an agency's written policy, injuries to another animal that came onto the owner's fenced property without consent, and injuries to certain trespassers while the dog was secured inside a fence or enclosure on the owner's property.
Comparative fault applies. Damages are figured under § 78B-5-818, so an insurer may argue the injured person provoked the dog and should bear a share. A share smaller than the defendants' combined fault reduces the award instead of ending it. Our damages page explains what can be recovered.
Deadlines. The general limit is four years (§ 78B-2-307), and for a child the period does not run until age 18 (§ 78B-2-108). See our deadline guide.
Reporting a Bite in Saratoga Springs
Animal control in Saratoga Springs sits within the police department's parking enforcement and animal control unit, reached through police non-emergency dispatch at 801-798-5600; call 911 if someone is badly hurt. Ask for a bite report. City code requires a dog that bites a person and breaks or scrapes the skin to be confined under observation at a veterinary hospital or animal shelter for fourteen days to rule out rabies (§ 9.01.14), and the report ties that dog, its owner and its vaccination record to your injury. For lost and impounded animals the city points residents to the North Utah Valley Animal Shelter at 193 North 200 West in Lindon.
Get the wound cleaned and examined the same day, because bites infect easily and hand punctures are often deeper than they look. Holy Cross Hospital – Mountain Point in Lehi runs a 24-hour emergency department, and American Fork Hospital at 170 North 1100 East also has an emergency department. Photograph the wounds as they heal, and write down the owner's name, address and insurer.
When the dog belongs to a tenant, the tenant's renter's policy is usually where coverage starts. Our guides on compensation for a Utah dog bite and what dog bite claims settle for explain how value is measured.
Injuries From Dog Attacks
Deep punctures and tears that need stitches or plastic surgery, scarring on the face and neck, nerve and tendon damage in the hands and forearms of people who tried to fend the dog off, infection, broken bones from being knocked to the pavement, and a lasting fear of dogs, which is especially common in young children.
What a Claim Should Cover
A complete demand accounts for:
- Treatment: the emergency visit, antibiotics, wound care, surgery and every follow-up.
- Future procedures: scar revision, including work a child may need after growing.
- Lost income: your missed work, or a parent's time off to care for a child.
- Pain and emotional harm: the injury itself and the anxiety or nightmares that can follow.
- Disfigurement: permanent scars, which weigh heavily when they are on the face or hands.
Answering the Owner's Insurer
Provocation is the defense insurers raise most, followed by trespass and the claim that a scar will fade. Each has an answer. Provocation is the owner's side to prove; the trespass exception in § 18-1-1 covers only trespassers hurt while the dog was secured inside a fence on the owner's property; and scarring should be judged by a surgeon months later, not by an adjuster in the first week. In Saratoga Springs the city's definition of control adds a point: a dog off its owner's land without a leash was not under control as the code defines it. Our Saratoga Springs personal injury page covers other injuries in the city.

Answers for People Bitten in Saratoga Springs
The dog had never bitten anyone. Can the owner still be liable?
Yes. Section 18-1-1 makes the owner or keeper liable whether or not the dog was known to be vicious. There is no prior-bite requirement in Utah.
The dog got out through a gate the owner thought was latched. Does that matter?
Not under the city's at-large rule. Saratoga Springs City Code § 9.01.05 treats the owner of a dog running at large as in violation regardless of the precautions taken to prevent its escape, and under state law the owner is liable for the bite either way.
Who do I call to report a dog bite in Saratoga Springs?
Call 911 for a serious injury. Otherwise call police non-emergency dispatch at 801-798-5600 and ask for animal control to take a bite report. The report documents the dog, the owner and the required observation period.
My child was bitten. Is there a deadline?
For a minor, Utah's limitations period generally does not run until the child turns 18 (§ 78B-2-108); adults have four years (§ 78B-2-307). Photographs, witnesses and the bite report are far easier to secure in the first weeks.
What will it cost to work with you?
The consultation is free. You pay nothing up front, and no attorney fees unless we win.
The dog belongs to a neighbor. Who actually pays?
Usually the neighbor's homeowner's or renter's insurance, which exists to cover this kind of loss. The claim is made against the policy and is typically handled by that insurer.
