Bountiful Pedestrian Accident Lawyer

Much of Bountiful's walking happens on streets built mainly for cars. People cross Main Street to reach shops, churches and City Hall at 795 South Main; children walk to neighborhood schools on streets that climb the east bench; and commuters walk to bus stops along the arterials. On 400 North and 500 South, the same crosswalks also serve drivers hurrying to and from I-15.
When a driver hits someone on foot, the insurer's first move is usually to shift the blame: you weren't in a crosswalk, you stepped out, you wore dark clothing. Utah's right-of-way rules protect pedestrians more than that script admits, and the answer usually lies in video and physical evidence from the first few days.
A Crosswalk Does Not Need Paint
Utah law treats the area at an intersection between the extended sidewalk lines as a crosswalk even when nothing is painted (§ 41-6a-102). A driver must slow or stop for a pedestrian in a crosswalk on the driver's half of the road, or approaching so closely from the other half as to be in danger; must come to a full stop at an occupied school crosswalk; and may not pass a vehicle stopped for someone crossing (§ 41-6a-1002).

Which Insurance Pays
More than one policy may be in play:
- The driver's liability coverage, which answers for pain, lost earning capacity and the rest of the losses once an injury meets Utah's threshold for a claim against the driver.
- Personal injury protection, which covers a named insured and resident relatives hurt in an accident involving any motor vehicle, and any pedestrian struck in Utah by the vehicle a policy describes (§ 31A-22-308). The no-fault guide explains its limits.

Sharing Fault, and the Clock
A pedestrian's award is cut by any share of fault assigned to them and barred at 50% or more (§ 78B-5-818). Most suits must be filed within four years, but if a UTA bus, a city vehicle, or a sidewalk or road defect is involved, a notice of claim is due within one year. See the statute of limitations page.
Bountiful Crossings Where Walkers Get Hit
Main Street downtown, a two-lane street with parked cars, driveways and cross traffic at nearly every block, where people step out between vehicles. 400 North and 500 South, the main links to I-15, where turning drivers are hunting for a gap in traffic instead of checking the crosswalk. The east bench, where steep grades lengthen stopping distances and drivers backing down sloped driveways have poor sight lines. Who responds: Bountiful Police (805 South Main Street, dispatch 801-298-6000) on city streets, and the Utah Highway Patrol on I-15 and Legacy Parkway. The FrontRunner station is in Woods Cross, so a crash there may be reported by a different agency.
What Causes These Crashes
Drivers turning right on red while looking left for traffic, left-turning drivers watching oncoming cars instead of the crosswalk, drivers backing out of driveways and parking stalls along Main, speed on the arterials, low evening sun to the west, winter darkness during the commute, and phones.
Injuries After Being Hit on Foot
Leg and pelvic fractures where the bumper strikes, head injuries from the hood, windshield or pavement, spinal injuries, and broken shoulders and wrists from the fall. What People Ask After Being Hit on Foot
I crossed at a corner with no painted lines. Was that a crosswalk?
Usually yes. Under Utah Code § 41-6a-102, the area at an intersection between the lines of the sidewalks is a crosswalk whether or not it is marked.
I was crossing Main Street in the middle of the block. Can I still recover?
Possibly. A pedestrian outside a crosswalk must yield, but a driver who was speeding or not watching may still carry most of the fault, and your recovery is reduced by your share unless that share reaches 50%.
A UTA bus hit me near a stop. Is anything different?
Yes. UTA is a government entity, so a written notice of claim generally must be filed within one year, well before the usual four-year deadline.
I don't own a car. Is there any PIP for me?
Possibly. Utah PIP covers a pedestrian injured in Utah by the vehicle a policy describes, so the driver's own PIP may pay early bills, and a relative's policy may cover you if you live in their household.
