Millcreek Pedestrian Accident Lawyer

Millcreek incorporated in 2016, and many of its streets were built when the area was unincorporated county land. On some older blocks the sidewalk stops without warning, commuter arterials like 3300 South and 3900 South run straight through neighborhoods, and the new city center at Millcreek Common, 1354 East Chambers Avenue, pulls people on foot to its public market, skating loop and splash pad.

Pedestrian Rights on Millcreek Streets

Inside a crosswalk, a driver has to slow or stop for a pedestrian on the driver's half of the road, or one coming so close from the far half as to be in danger, and may not pass a car that has stopped for someone crossing (Utah Code § 41-6a-1002). An intersection has a crosswalk even with no paint: Utah defines it by the sidewalk lines carried across the road, and where only one side has a sidewalk, by that sidewalk's lines extended at right angles to the centerline (§ 41-6a-102).

Where no sidewalk is provided, Utah tells people on foot to use the shoulder, and where there is no shoulder either, to keep as near the outside edge as practicable and face oncoming traffic on a two-way road (§ 41-6a-1009). Insurance That May Apply

After a Millcreek pedestrian crash, look for coverage in roughly this order:

  • PIP. The personal injury protection on your household's auto policy covers you on foot, and if your household has no policy, the PIP on the car that hit you can cover a pedestrian hurt in Utah (§ 31A-22-308). Utah reduces damages by your share of fault and bars recovery at 50% or more (§ 78B-5-818). Most injury suits must be filed within four years, but when a city, county, UDOT or UTA vehicle or road condition was involved, a notice of claim is due within one year (§ 63G-7-402), and in Millcreek, finding the right owner of the road is part of meeting that deadline.
