Holladay Slip and Fall Lawyer

Hurt in a fall at Holladay Village, an Olympus Hills store, an apartment complex or a public walkway? The party responsible for that property may owe you compensation. Free consultation, and no attorney fees unless we win.

Holladay is a bench city of about 31,900 people spread over 8.5 square miles, and its fall claims look different from those in the valley's retail corridors. There is no enclosed mall here any more; the commercial life runs through Holladay Village at Murray-Holladay Road and Holladay Boulevard, the Olympus Hills center near Wasatch Boulevard, and the strip frontage along Highland Drive. Add residential sidewalks laid decades ago under a heavy tree canopy, and most of what we see comes down to surfaces that shifted, iced or were never cleared.

Elevation matters more than people expect. Holladay sits above the valley floor against the Wasatch front, so snow arrives earlier, lingers longer and refreezes overnight on walks that looked clear at noon. A property owner who clears once in the morning and does not return has often not done enough, and the weather record for that day is usually the first thing worth pulling.

Making a Holladay Fall Claim

A fall rarely produces a police report. The case turns instead on proving a dangerous condition existed, that the owner or manager knew about it or reasonably should have, and that it is what put you on the ground.

At a multi-tenant center, the property owner, the individual business and a landscaping or snow-removal vendor may each control different ground, so exactly where you went down decides who answers for it. Note the business name or nearest entrance, ask for an incident report in writing, and send a preservation request for any video before the system records over it.

How Utah Defines an Owner's Duty

What the property owner owed you depends on why you were there:

  • Customers and residents are owed routine inspection, and hazards have to be fixed or clearly marked.
  • Guests at a private home must be warned about dangers the host already knows about.
  • Trespassers are owed a good deal less.

An argument that the hazard was obvious can cut a recovery, but it does not end the claim. Where the owner could expect people to use that entrance or walkway anyway, the owner still had to address it.

Fault is shared. Utah Code § 78B-5-818 blocks recovery unless the defendants' combined fault exceeds yours, and it trims the award by your percentage. Adjusters in Holladay cases reach for footwear, whether you were carrying something, and whether you were watching where you walked.

Time limits. Most claims against private owners must be filed within four years. A fall on Holladay City property, or on a Salt Lake County park such as Big Cottonwood Regional Park, requires a written notice of claim inside one year (§ 63G-7-402). Our statute of limitations page walks through each deadline.

Where Holladay Falls Happen

Holladay Village and the Highland Drive frontage, where wet entry tile, curb transitions between the sidewalk and the parking bays, and untreated ice in the rows are the recurring complaints.

The Cottonwood Mall redevelopment site at 4835 Highland Drive, 57 acres in active construction since the mall closed in 2007. Temporary walkways, plated trenches and rerouted pedestrian paths around a construction zone raise questions for the contractor and the site owner, not only the eventual tenant.

Public ground, where the one-year notice applies: Holladay City property including the civic campus at 4580 South 2300 East, and county parkland such as the Holladay Lions area of Big Cottonwood Regional Park and Knudsen Park. For a vehicle crash, see our Holladay car accident page; for other injuries, our Holladay personal injury page.

Hazards Behind Holladay Falls

Sidewalk slabs heaved by mature tree roots, driveway aprons that settled out of level, refrozen meltwater below downspouts and north-facing walls, worn stair treads on older commercial buildings, unlit rear entrances and service walks, and entry mats that curl once they are soaked.

Common Injuries

Falls produce wrist, ankle and hip fractures, shoulder tears, spinal injuries and concussions. Intermountain Medical Center on Cottonwood Street in neighboring Murray is the closest Level I trauma center, a few minutes west on Murray-Holladay Road.

Recoverable Losses

  • Bills and income: emergency and surgical costs, rehabilitation, prescriptions and work you could not do.
  • Personal harm: pain, the limits placed on ordinary life and the toll of a long recovery.
  • Future needs: continuing treatment and reduced earning power where the injury does not fully resolve.

Arguments the Owner's Insurer Makes

Expect to hear that the spill had only just happened, that a different tenant controlled that ground, or that you simply were not looking. Sweep and snow-removal logs, video, National Weather Service records for that day and a written incident report are what answer them. A Holladay fall suit is filed in Third District Court for Salt Lake County, at the Matheson Courthouse, 450 South State Street, or the West Jordan courthouse on Redwood Road. Common Questions

Holladay Fall Questions

I fell at a Holladay Village business. Is the center or the tenant responsible?

It depends on who controlled that spot. Shared walkways and parking are usually the property owner's responsibility and the interior of a business is usually the tenant's, though the lease between them can move that line.

I slipped in a county park in Holladay. What deadline applies?

Big Cottonwood Regional Park is Salt Lake County property, so a written notice of claim is due within one year. Do not rely on the four-year period that covers most private claims.

Am I barred from recovering if I was partly careless?

Not necessarily. Under Utah Code § 78B-5-818 your award drops by your share of fault, and you recover only where the defendants' combined fault is greater than yours.

How are your fees paid?

You pay nothing up front, and no attorney fees unless we win. The fee is taken from the recovery, and the written agreement explains how case costs are handled.

I fell on an icy sidewalk outside a Holladay business. Can I bring a claim?

Possibly. The question is what the owner did and when. Photograph the ice and the surrounding walk before anyone salts it, note the time, and keep the shoes you were wearing.

What should I do first after a fall in Holladay?

See a doctor, report the fall in writing to the business or property manager, photograph the hazard and your shoes, and take down witness names and phone numbers.
