South Jordan Pedestrian Accident Lawyer
Struck while walking in Daybreak, near a TRAX platform or crossing Redwood Road? Free case review, and no attorney fees unless we win. Hablamos Español.
South Jordan grew up around the car, then Daybreak added thousands of homes designed for walking: sidewalks to Oquirrh Lake, paths to schools and parks, and two TRAX Red Line stations on South Grandville Avenue, South Jordan Parkway at 10605 South and Daybreak Parkway at 11405 South, where the line ends. On the east side, the FrontRunner station at 10351 South Jordan Gateway brings commuters on foot between trains, buses and parking. The result is a suburb where people walk in numbers some drivers still do not expect.
After a driver hits someone on foot, the insurer usually turns the questions on the pedestrian: where they crossed, what they wore, whether they looked up. Utah law protects pedestrians more than that framing suggests, and the exact place and manner of the crossing matter. If you were in a vehicle instead, see our South Jordan car accident page.
What Utah Law Requires of Drivers
Every intersection has a crosswalk, painted or not. Utah's definition covers the part of the roadway at an intersection within the connected lines of the sidewalks on either side (Utah Code § 41-6a-102). A driver has to slow down or stop for someone in a crosswalk on the driver's half of the road, come to a full stop for an occupied school crosswalk, and never go around a car that has stopped to let a person cross (§ 41-6a-1002).
The rules also bind the walker. A pedestrian may not step off the curb into the path of a car too close to stop, must yield when crossing outside a crosswalk, and between two intersections with working signals may cross only at a marked crosswalk (§ 41-6a-1003). On long blocks of 10400 or 11400 South, that last rule is where insurers focus. Breaking it can shift some fault to the pedestrian; it does not automatically clear the driver. Our pedestrian accident guide explains how the percentages are set. For statewide crash figures and Utah crosswalk law, see our Utah pedestrian accident lawyer page.
Insurance That Can Pay a Pedestrian
More than one policy may apply:
- The driver's bodily injury liability coverage, which answers for pain, lost income and bills beyond what your own coverage pays.
- PIP under your own auto policy, which can pay early medical bills and part of lost wages even though you were on foot, depending on how the policy defines who is covered. The no-fault guide has the details.
When the driver carries only minimum limits or cannot be found, your uninsured and underinsured motorist coverage can fill in. For a driver who left the scene, our hit-and-run guide lists the steps to take.
Shared Fault and the Clock
A pedestrian's recovery is reduced by the pedestrian's own percentage of fault and barred if that share reaches 50% (§ 78B-5-818). You generally have four years to sue a driver, but a TRAX train, a UTA bus or a South Jordan City vehicle turns it into a government claim with a one-year notice deadline. The full list is on our deadlines page.
South Jordan Crossings That Call for Care
Daybreak near the Red Line, where people cross South Grandville Avenue and nearby streets to reach the South Jordan Parkway and Daybreak Parkway platforms. Oquirrh Lake and the Daybreak paths, where trails meet neighborhood streets. 10400 and 11400 South, wide arterials lined with retail driveways and long gaps between signals. Redwood Road, a busy state route through the older part of the city. The FrontRunner station on Jordan Gateway, where commuters walk between the platform, buses and the parking lot. UDOT’s crash counts for each South Jordan signal are on our South Jordan dangerous intersections page.
South Jordan Police, based at 10655 South Redwood Road, investigate collisions on city streets, and the Utah Highway Patrol generally handles the interstate. For injuries that did not happen on foot, our South Jordan personal injury page covers the other claims we take.
Common Causes
Drivers turning right on red while looking left for a gap, left-turning drivers watching oncoming traffic instead of the crosswalk, cars backing out of driveways and parking stalls, speed on roads built for through traffic, low sun at dawn and dusk, and phones.
Injuries to People on Foot
A person hit by a car usually takes two impacts, first the bumper and then the hood or the pavement. That produces leg and pelvic fractures, head injuries, spinal injuries and broken arms and wrists. A broken bone is one of the ways Utah law lets you claim pain and suffering from the driver. Riverton Hospital, a Level IV trauma center, is close by to evaluate and stabilize; the most serious trauma may go to Intermountain Medical Center in Murray, a Level I center, and children to Primary Children's, which is also Level I.
What a Claim Can Include
- Economic losses: emergency care, surgery, therapy, future treatment, and income you lose now or later.
- Non-economic losses: pain, emotional distress and the activities the injury takes away.
- Permanent injury costs: care, equipment and home changes when recovery is incomplete.
- Wrongful death damages: when a pedestrian does not survive. Our Utah wrongful death guide explains who may bring that claim.
What the Insurer Will Say
Expect "dark clothing," "stepped out suddenly" or "not in a crosswalk," often with an early offer made before anyone knows how serious the injury is. Signal timing, the layout of the crossing, street lighting, and video from nearby homes, businesses, buses or trains can answer those points, if someone requests the footage before it is recorded over. The steps in a Utah injury case show the path from there.

South Jordan Pedestrian FAQs
I crossed at a corner in Daybreak with no painted lines. Was that a crosswalk?
Likely yes. Under Utah law, the area at an intersection within the connected sidewalk lines is a crosswalk even without paint, and drivers must yield to you there.
I crossed 10400 South in the middle of the block. Can I still recover?
Possibly. Outside a crosswalk you must yield to traffic, but a speeding or distracted driver can still carry more of the fault. Your recovery is reduced by your share and barred only if your share reaches 50%.
A TRAX train or UTA bus was involved. Is anything different?
Yes. A claim against UTA is a claim against a government entity, so a written notice of claim must be filed within one year, well before the usual four-year deadline.
Will my own car insurance help if I was walking?
Often. Your PIP may pay early medical bills and part of lost wages depending on your policy, and uninsured motorist coverage can apply after a hit-and-run.
What does hiring you cost?
The consultation is free. You pay nothing up front, and no attorney fees unless we win.
How long do I have to act?
Usually four years to file against a driver, but one year for a notice of claim when a government entity is involved. Video from homes and businesses can disappear much sooner.
