West Jordan Pedestrian Accident Lawyer

Hit while walking in West Jordan, near a TRAX station, on Redwood Road or in a Jordan Landing parking lot? Free case review, and no attorney fees unless we win. Hablamos Español.

West Jordan was laid out for cars, but plenty of people still cover the last stretch on foot: from a Red Line platform at Historic Gardner, West Jordan City Center, 2700 West Sugar Factory Road or Jordan Valley to home or work, across a wide arterial to reach a bus stop, or from a parked car to a store entrance. Those short walks are where a driver watching traffic instead of people does serious harm.

The driver's insurer usually opens with blame: you were not in a crosswalk, you stepped out, you were wearing dark clothes. Utah law protects people on foot more than that script admits, and in West Jordan the answer often lies in signal timing, street lighting and store or traffic video.

What Counts as a Crosswalk

A crosswalk does not need paint. At an intersection, the area within the extended sidewalk lines is a crosswalk under the definitions in Utah Code § 41-6a-102. A driver must slow or stop for someone crossing in a crosswalk on the driver's half of the road, must come to a full stop at an occupied school crosswalk, and may not pass a vehicle that has stopped to let someone cross (§ 41-6a-1002).

Outside a crosswalk the pedestrian must yield, and between two neighboring intersections that both have working signals, a pedestrian may cross only in a marked crosswalk (§ 41-6a-1003). On Redwood Road, where signals can be far apart, that rule is the insurer's favorite argument. It can shift part of the fault to you; it does not excuse a driver who was speeding or not looking. Our pedestrian guide explains how fault gets divided. For statewide crash figures and Utah crosswalk law, see our Utah pedestrian accident lawyer page.

Insurance That Can Pay

In a West Jordan pedestrian case, money can come from more than one policy:

  • The driver's bodily injury liability coverage, which answers for pain, lasting harm and costs beyond the early benefits.
  • Personal injury protection. Under Utah Code § 31A-22-308, your own PIP covers you when you are hurt in an accident involving any motor vehicle, relatives living in your household are covered too, and a pedestrian injured in Utah can also claim under the PIP on the vehicle involved. PIP pays at least $3,000 of medical expenses plus part of lost income (§ 31A-22-307). The no-fault guide explains more.

If the driver carries too little insurance or drives away, uninsured and underinsured motorist coverage may apply. After a hit-and-run, read what to do next.

Shared Fault and the Clock

Your recovery shrinks by your percentage of fault and stops entirely if your share is not smaller than the combined share of the others at fault (§ 78B-5-818). Most suits must be filed within four years; if a TRAX train, a UTA bus, a city vehicle or a defect in a public road is involved, a written notice of claim is due within one year (§ 63G-7-402). The deadlines page lists the rest.

West Jordan Places Where People on Foot Get Hit

Redwood Road, wide and fast, with bus stops, apartments and businesses on both sides and long distances between signals. Around the Red Line stations, where riders cross streets and parking areas to reach the platforms. Jordan Landing and the 7000 South retail area, where people walk through busy parking aisles and across drive entrances. Neighborhood streets near schools and parks, where children step out between parked cars. The signals with the most recorded crashes are ranked on our West Jordan dangerous intersections page.

Who investigates: the West Jordan Police Department, headquartered at 8040 South Redwood Road, inside the city, and sometimes the Utah Highway Patrol on highway segments. Get the case number before you leave the scene or the hospital.

Why Drivers Hit Pedestrians Here

Drivers turning right on red while looking left for a gap, left-turning drivers focused on oncoming cars, speed on arterials built for traffic flow, glare and weak lighting after dark, drivers backing out of stalls at retail centers, and distraction at the moment a light changes.

The Injuries

Leg and pelvic fractures at bumper height, head injuries from the hood, windshield or pavement, spinal injuries, and broken wrists and shoulders from the fall. Where Utah's no-fault threshold applies, a bone fracture of any kind meets it, as do medical expenses over $3,000 (§ 31A-22-309). Holy Cross Hospital – Jordan Valley, at 3580 West 9000 South, lists a Level II state trauma designation.

What You Can Recover

  • Economic losses: medical bills now and later, lost wages and lost earning capacity.
  • Non-economic losses: pain, emotional distress and the activities the injury took away.
  • Future care: therapy, home help and equipment for injuries that do not fully heal.
  • Wrongful death damages: for a family that has lost someone; our wrongful death guide summarizes Utah's rules.

How Insurers Push Back

Expect lines like “came out of nowhere,” “was on a phone” and “it was dark,” followed by an early offer. The facts that answer them are perishable: signal timing records, store and gas-station cameras, and the lighting at the exact spot. Our West Jordan car accident page covers how the same corridors produce vehicle crashes, and the West Jordan personal injury page covers other injuries in the city.

West Jordan Pedestrian Questions

What People Ask After Being Hit on Foot in West Jordan

There were no painted lines where I crossed. Was I in a crosswalk?

If you crossed at an intersection, probably yes. Utah treats the area within the extended sidewalk lines at an intersection as a crosswalk whether or not it is marked.

I crossed Redwood Road in the middle of the block. Can I still recover?

Possibly. A pedestrian crossing mid-block must yield, which may put part of the fault on you, but a speeding or inattentive driver can still carry most of it. Your recovery is reduced by your share as long as that share is smaller than the others' combined.

I was hit near a TRAX station by a train or a UTA vehicle. Is the process different?

Yes. UTA is a government entity, so a written notice of claim must be filed within one year under the Governmental Immunity Act, and other procedural rules apply.

I don't own a car. Is there PIP for me?

Possibly. Utah Code § 31A-22-308 lets a pedestrian hurt in a Utah accident claim PIP under the policy on the vehicle involved, and a policy held by a relative in your household may also cover you.

What does it cost to hire you?

The consultation is free, and there are no attorney fees unless we win.

How long do I have?

Generally four years to sue, but only one year for a notice of claim when a government entity is involved. Video and witness memories fade much sooner.
