West Jordan Slip and Fall Lawyer
Injured after slipping or tripping at a West Jordan shopping center, apartment or public park? The party in control of that property may have to answer for it. Free consultation, and no attorney fees unless we win.
West Jordan's fall cases center on its large retail districts, above all Jordan Landing and the centers along 7000 South and 9000 South, and on the apartment communities and new subdivisions spreading west toward Mountain View Corridor. Many of the properties are big, busy and maintained by someone other than the store whose door you were headed for.
City crews plow more than 900 lane miles of streets, along with bike lanes, parks and many blocks of sidewalk (West Jordan Public Works). Most of the walkways and lots where people actually fall, though, belong to private owners who run their own clearing or hire it out.
Proof in a West Jordan Case
Because nobody writes an accident report for a fall, the claim is built from scratch: the hazard, the owner's actual or constructive knowledge of it, and the connection between that hazard and your injury.
At a retail center like Jordan Landing, a store may lease its space while a separate owner or association handles the lot and sidewalks. Note the storefront nearest the spot, photograph signs naming a management company, and send preservation requests to each.
How Utah Sets the Duty
Utah law asks why you were on the property before deciding what the owner owed:
- Business invitees, including shoppers and apartment residents, are owed reasonable inspection and a fix or an adequate warning.
- Licensees, such as dinner guests, are owed a warning of dangers the owner knows about.
- Trespassers are owed only a limited duty.
Expect to hear that the hazard was in plain view. That point can shave a recovery, but it does not protect an owner who should have foreseen that people would still walk through it.
Allocation of fault. Utah's § 78B-5-818 lets you recover only when the defendants' combined fault exceeds your own, and your percentage is deducted from the award.
Time limits. A claim against a private owner generally must be filed within four years. A fall in a West Jordan city park, on a city sidewalk or at another public facility calls for a written notice of claim within one year (§ 63G-7-402). Our Utah deadlines page covers the rest.
West Jordan Fall Hotspots
Jordan Landing, reached from Bangerter Highway and 7000 South, where a dense grid of stores, restaurants and parking aisles means entrances, curbs and lots are controlled by many different owners and tenants.
Big-box and grocery stores along 7000 South, 9000 South and Redwood Road, where wet entrances and cart corrals are the usual trouble, plus apartment complexes where stairs and breezeways are the landlord's responsibility.
City parks, sidewalks and recreation facilities, owned by West Jordan, where the one-year notice rule applies. If a vehicle was involved, our West Jordan car accident page explains that claim, and our West Jordan personal injury page covers the broader picture.
West Jordan Hazards
Cart-return areas slick with slush, curb stops hidden in dark lots, breezeway stairs that ice over, entry floors wet from tracked-in snow, cracked concrete at store fronts, and missing handrails on short flights of steps.
What a Fall Can Do
Wrist, hip and ankle fractures, torn rotator cuffs, spinal injuries and traumatic brain injuries. The most serious cases in this part of the valley are often taken to Intermountain Medical Center in Murray, a Level I trauma center.
Damages Available
- Economic damages: treatment costs past and future, lost income and reduced earning capacity.
- Non-economic damages: pain, mental anguish and loss of the life you had before.
- Life-care costs: when a fall causes lasting disability.
The Insurance Response
A retail insurer may point at the tenant, the tenant may point at the landlord, and both may say the spill appeared seconds earlier. Sweep logs, snow-contractor invoices, lease terms and store video settle those disputes when requested in time. West Jordan cases go to the Third Judicial District Court, which sits at the Matheson Courthouse in Salt Lake City and at 8080 South Redwood Road in West Jordan. Our Utah slip and fall guide and how a Utah injury case unfolds explain more.

West Jordan Fall Questions
I fell in a Jordan Landing parking lot. Is the store responsible?
Maybe, but often the lot is run by the center's owner or a management company rather than the store. The lease and maintenance contracts show who controlled that area.
The insurer says the spill had just happened. What now?
The question becomes whether the store had time to find it with reasonable inspection. Sweep logs and video from the aisle often show how long a spill was there.
If I was looking at my phone, can I still recover?
Possibly. Under Utah Code § 78B-5-818 your share of fault reduces the award, and recovery is barred only if your fault is equal to or greater than the defendants' combined fault.
How do you charge?
You pay nothing up front, and no attorney fees unless we win. The written agreement explains how case costs are handled.
I fell in a West Jordan city park. How long do I have?
A written notice of claim must be filed with the city within one year of the fall, well before the general four-year limit.
What should I do before leaving the store?
Report the fall to a manager, ask for a copy of the incident report, photograph the floor or walkway, and get the names of employees and witnesses.
