Herriman Motorcycle Accident Lawyer

Knocked off your motorcycle on Mountain View Corridor, Bangerter Highway or 13400 South in Herriman? Free consultation, and no attorney fees unless we win.

Herriman is still being built, and riders feel it first. New neighborhoods open onto streets that were dirt a season ago, lane shifts move from one month to the next, and construction trucks track mud and rock across fresh asphalt. A driver may barely notice a patch of loose stone in a turn; on two wheels it can put you on the ground.

When a Herriman rider is hurt, we start by pinning down what the road looked like that day, where the other driver was looking, and whether anything was left on the pavement that should not have been there. Those facts fade fast in a city that repaves and restripes constantly. If you were hurt some other way, our Herriman personal injury page covers those claims.

Where Herriman Riders Go Down

Mountain View Corridor pairs near-freeway speed with signalized cross streets, so a driver turning left onto or off the corridor has only a moment to judge a single headlight coming at them. When that judgment is wrong, Utah Code § 41-6a-903 puts the duty on the turning driver: yield to any oncoming vehicle close enough to be an immediate hazard. A motorcycle gets the same protection as any other vehicle under that rule.

The Utah Rules That Shape a Herriman Claim

Splitting past stopped traffic. Utah lets a motorcyclist filter only when the cars ahead are stopped, the road has at least two lanes your way, the posted limit is 45 mph or less (or you are on a multi-lane off-ramp), and you keep it to 15 mph (§ 41-6a-704(6)). On a stretch signed faster than 45, it is not allowed at all. The details are in our Utah lane filtering guide.

The helmet argument. Riders under 21 must wear one. For everyone else, § 41-6a-1505(6) keeps helmet use out of the fault analysis: skipping it is not comparative negligence and cannot be offered as evidence about negligence, injuries or mitigation in a civil suit.

No-fault stops at the car door. Motorcycle policies are not required to include personal injury protection under § 31A-22-302, and a rider is not covered by PIP while operating the bike, so the injury threshold that limits many car-crash claims generally does not stand in a rider's way. Our guide to Utah motorcycle claims explains who pays the early bills.

Thin policies. A Utah auto policy written or renewed since January 1, 2025 must carry at least $30,000 of bodily-injury coverage per person (§ 31A-22-304). If that runs out, underinsured motorist coverage on your own policy may pick up where it stops.

Clocks. Most injury suits must be filed within four years and death claims within two, but a claim against Herriman City, UDOT or another public body needs a written notice of claim within one year (§ 63G-7-402). Our deadline page lists the exceptions.

Herriman Roads That Demand Attention

Bangerter Highway mixes newer interchanges with remaining signals, so a rider can go from free-flowing traffic to a red light in a short distance, and a following driver who has not adjusted may close the gap before braking. 13400 South and the connectors through the city center carry school buses, parents and contractor vehicles in the same lanes at the start and end of the school day. On any of them, a lane that was there last month may have moved.

The Herriman Police Department at 5355 West Main Street takes crashes on city streets and handles report requests through the city's police records page; the Utah Highway Patrol may take a crash on a state highway. Herriman's own city court hears traffic citations, which are separate from your injury claim. Ask for the agency and case number before you are transported.

How Herriman Motorcycle Crashes Happen

A driver leaving a new subdivision who looks for cars and misses a bike; a dump truck changing lanes with a rider in its blind spot; a car rear-ending a motorcycle stopped at a signal on Bangerter; a rider who hits construction debris, a steel plate or an unmarked pavement edge in a work zone. When a contractor or public agency controlled that work zone, the claim may reach past the drivers involved.

Injuries and Where Riders Are Treated

Riders take the force of a crash on the body: head and brain injuries even with a helmet, shoulder and collarbone fractures, broken ankles and shins, pelvic and spinal injuries, and road rash that can need surgery. Intermountain Riverton Hospital at 3741 West 12600 South is a Level IV trauma center that evaluates and stabilizes, and the most serious injuries continue on to Intermountain Medical Center in Murray, a Level I center.

What a Herriman Rider Can Recover

  • Money already lost: ambulance, surgery and therapy bills, missed paychecks, and the motorcycle, helmet, jacket and boots.
  • Pain and daily life: physical pain, disrupted sleep, and the riding season, work and family time the crash took.
  • The road ahead: future surgeries, reduced earning ability, and equipment or home changes when an injury is permanent.
  • Punitive damages: uncommon, and limited to conduct such as impaired or deliberately reckless driving.

Answering the Didn't-See-the-Bike Defense

Insurers in Herriman cases lean on the same lines: the rider was too fast, the rider came out of nowhere, the construction made the road confusing. The response is physical: photos of the striping and cones as they stood, the motorcycle's resting point, damage angles, doorbell and dashcam video from nearby homes, and the other vehicle's data. Under § 78B-5-818 a rider recovers nothing unless the others' combined fault is greater than the rider's own, so every percentage point matters. Our Herriman car accident page covers local reports and roads, and the steps in a Utah injury case show what comes next.

Common Questions

Questions From Herriman Riders

A car turned left in front of me on Mountain View Corridor. Who is responsible?

Usually the turning driver. Utah Code § 41-6a-903 requires a driver turning left to yield to oncoming traffic close enough to be an immediate hazard, and a motorcycle counts. The insurer will likely question your speed, so preserve photos, video and witness names.

I hit gravel or debris in a Herriman construction zone. Can anyone be held responsible?

Possibly. A contractor or public agency that controlled the work zone may share fault if the road was left in an unsafe condition. If a government entity is involved, a written notice of claim is due within one year, so photograph the area before it is swept or repaved.

I was not wearing a helmet. Does that reduce my claim?

No. Utah Code § 41-6a-1505(6) says not wearing protective headgear is not comparative negligence and cannot be introduced as evidence of negligence, injuries or mitigation of damages in a civil case. Riders under 21 are still required to wear one.

Will PIP cover my motorcycle crash?

Generally not. Utah does not require PIP on motorcycle policies, and riders are not covered by PIP for injuries while operating a motorcycle. Health insurance, any medical payments coverage you bought, and the at-fault driver's liability coverage are the usual sources.

What does it cost to hire a lawyer for my motorcycle claim?

You pay nothing up front, and no attorney fees unless we win. The fee is a percentage of any recovery, and case costs are explained in the written agreement before you sign.

How soon do I need to act?

Most injury lawsuits must be filed within four years and wrongful death claims within two, but a claim against a city, county or UDOT needs a notice of claim within one year. Work-zone layouts and home security video can disappear within days, so earlier is better.
