South Jordan Slip and Fall Lawyer
Hurt in a fall at The District, on a Daybreak walkway, on an apartment stair or inside a South Jordan store? The owner or manager who controlled that spot may have to pay for your injuries. Free consultation, and no attorney fees unless we win.
South Jordan grew fast, and much of its property is new: shopping at The District, mixed-use blocks and townhomes in Daybreak, and apartment communities along the Bangerter and Mountain View corridors. New construction is not the same as safe footing. Unfinished walkways, sprinkler overspray that freezes on concrete, and entrances shared by several tenants are where many South Jordan falls begin.
The city says its Streets Division maintains and inspects city-owned sidewalks to keep them free of trip hazards and obstructions (South Jordan Streets & Lighting). That matters for two reasons: a heaved or broken public sidewalk may be the city's responsibility rather than a neighbor's, and a claim against the city runs on a much shorter notice deadline than a claim against a store or landlord.
Proving a South Jordan Fall Case
The central question is notice. You need to show that the hazard existed, that whoever controlled the property knew about it or would have found it with reasonable care, and that it caused you to fall. Proof of how long a condition had been there usually settles whether the owner should have known.
In a planned community, responsibility is often layered: a homeowners association may own the common walkways, a management company may run the building, and a landscaper may handle snow. Ask for the incident report at any store, keep your shoes and clothing as they were, and send a written request to preserve camera video right away.
Duties Utah Places on Owners
The level of care depends on your status on the property:
- Business visitors and renters are owed reasonable inspection, plus repair of any hazard or a clear warning about it.
- Invited guests in a home are owed a warning about dangers the owner actually knows are there.
- Uninvited entrants have only narrow protection.
Insurers like to call a hazard open and obvious. That can cut into the value of a claim, yet it is not a complete defense if the owner should have expected customers or residents to walk across it anyway.
Comparative fault. Utah Code § 78B-5-818 allows recovery only when the defendants' combined fault is greater than yours, and it reduces the award by your share. Expect questions about what you were carrying, what shoes you wore and whether you were distracted.
Deadlines. Four years is the usual limit against a private owner. A fall on a city sidewalk or at another public facility needs a written notice of claim within one year (§ 63G-7-402), and the same one-year rule applies on UTA property such as the TRAX Red Line platforms in Daybreak. Our deadline page covers the rest.
Where South Jordan Falls Happen
The District's parking lots and storefronts, where plowed snow piles melt across drive aisles and refreeze overnight, and busy restaurant entrances track water onto tile floors.
Daybreak's walkable streets, shared courtyards and the paths around Oquirrh Lake, where an HOA, a builder or a commercial owner may control the surface you fell on.
Public parks, including Bingham Creek Regional Park at 5000 West 10200 South, which is operated by a regional park authority working with Salt Lake County Parks and Recreation. Public ownership brings in the one-year notice. For a vehicle crash, see our South Jordan car accident page; for other injuries, our South Jordan personal injury page.
South Jordan Hazards We Look For
Frozen sprinkler runoff on walks, curbs painted the same color as the pavement, new asphalt edges that drop away, missing stair nosing in apartment buildings, dim parking garages, and floors mopped without a warning sign.
Injuries From Falls
Broken wrists and ankles, torn knee ligaments, hip fractures in older adults, and head injuries from hitting pavement are all common. Intermountain Riverton Hospital, a Level IV trauma center, is close by for evaluation; the most serious injuries go to Intermountain Medical Center in Murray, a Level I center.
Damages You Can Claim
- Economic loss: medical bills, therapy, lost wages and reduced future earnings.
- Non-economic loss: pain, stress and the everyday activities an injury takes away.
- Permanent effects: future care and changes at home when you never fully recover.
What the Defense Will Say
Owners and their insurers often claim the spill was only seconds old, that the HOA rather than the tenant was responsible for the ice, or that you should have taken another route. Dated photos, maintenance records and messages to management rebut those arguments. If a South Jordan case has to be filed, it goes to Third District Court for Salt Lake County, which hears cases at the Matheson Courthouse and at the West Jordan courthouse, 8080 South Redwood Road. South Jordan Fall Questions
I fell on an HOA walkway in Daybreak. Who do I claim against?
Usually whoever controlled that walkway: the HOA, a management company, or a snow-removal contractor. The association's governing documents and service contracts show who had the job.
Does the deadline change if I tripped on a city sidewalk in South Jordan?
Yes. A claim against the city requires a written notice of claim within one year. Most claims against private owners allow four years.
What if the insurer says I was partly at fault?
Utah reduces your award by your own share of fault, and you recover nothing unless the defendants' combined fault is greater than yours (Utah Code § 78B-5-818).
What will it cost me to hire you?
You pay nothing up front, and no attorney fees unless we win. The fee comes out of the recovery, and your written agreement explains how case costs are handled.
I fell on a TRAX platform. Is that handled differently?
UTA is a public entity, so a written notice of claim is due within one year. Report the fall to UTA and keep a record of the station, the date and the time.
What evidence should I collect?
Photos of the hazard and your shoes, the names of witnesses, a copy of any incident report, and a written request that the owner keep its video.
