Salt Lake City Car Accident Lawyer
Injured in a crash that wasn't your fault? You pay nothing up front, and no attorney fees unless we win. Free consultation — Hablamos Español.
A car accident can turn an ordinary Tuesday into months of doctor's visits, missed paychecks, and phone calls from an insurance adjuster who is friendly right up until it's time to pay. You didn't choose any of this — but you do get to choose who stands with you.
At West Injury Law, we handle the insurance companies, the medical bills, and the paperwork so you can focus on getting better. And because we work on contingency, you owe us nothing unless we recover money for you.
You Heal. We Handle the Fight.
After a serious crash, the insurance company goes to work immediately — and not for you. Their adjusters are trained to get a recorded statement, offer a fast lowball settlement, and close the file before you know the full extent of your injuries.
We do the opposite. We build your case carefully: gathering the police report, medical records, and evidence; calculating the true value of your claim, including future care and lost earning capacity; and negotiating from a position of strength. If the insurer won't be reasonable, we're prepared to take them to court.
Utah Car Accident Laws You Should Know
Utah is a "no-fault" state. Every Utah auto policy includes Personal Injury Protection (PIP), which pays your initial medical bills and a portion of lost wages regardless of who caused the crash — up to your policy limits (a minimum of $3,000). You use your own PIP first.
When you can pursue the at-fault driver. No-fault has a threshold. If your medical expenses exceed $3,000, or you suffered a permanent injury, permanent disfigurement, or dismemberment, you can step outside the no-fault system and bring a claim against the driver who hurt you — for the full range of damages, including pain and suffering. (Utah Code § 31A-22-309.)
You have a deadline. In Utah, you generally have four years from the date of the crash to file a personal injury lawsuit, and two years for a wrongful death claim. Miss the deadline and you can lose the right to recover anything — which is why it's smart to talk to a lawyer early, while evidence is fresh.
Fault is shared on a sliding scale. Utah follows modified comparative negligence with a 50% bar. Your compensation is reduced by your share of fault — and if you're found 50% or more responsible, you recover nothing. Insurers know this rule and will try to pin as much blame on you as possible. Part of our job is making sure that doesn't happen.
Minimum coverage is often not enough — and why UM/UIM matters. Utah requires every driver to carry at least $30,000 per person / $65,000 per accident / $25,000 property damage. But a serious injury can easily cost far more than those limits — and some drivers on the road carry no insurance at all. That's why we strongly encourage carrying uninsured/underinsured motorist (UM/UIM) coverage on your own policy. If the driver who hurt you has no insurance, or not enough to cover your injuries, your UM/UIM coverage can step in and pay the difference. It's relatively inexpensive protection that can make all the difference after a serious crash — and it's one of the first things we check when reviewing your case.
Utah Car Accident Statistics
Utah's roads are busier — and more dangerous — than many people realize. According to preliminary 2024 data from the Utah Department of Transportation (UDOT) and the Utah Department of Public Safety, 281 people were killed on Utah roads in 2024, up slightly from 279 the year before. Behind that number:
- 110 deaths involved drugs or alcohol
- 78 were tied to speeding and speed management
- 22 involved distracted driving
- More than a third of those killed were not wearing a seat belt
- Vulnerable road users were hit especially hard: 53 motorcyclists (a 15-year high), 43 pedestrians, and 7 bicyclists
The hard truth in these figures is that the vast majority of serious crashes are preventable — caused by a driver who was impaired, speeding, or distracted. When someone else's careless choice injures you or takes someone you love, you have every right to hold them accountable.

Common Causes of Car Accidents in Utah
Most crashes come down to a driver who wasn't paying attention or wasn't following the rules of the road. The most common causes we see include distracted driving (texting, phones, in-car screens), speeding and aggressive driving, impaired driving, running red lights and stop signs, tailgating, and hazardous winter road conditions along the Wasatch Front. When another driver's carelessness caused your injuries, they — and their insurer — should be held accountable. For the Salt Lake City streets where those crashes pile up, see Salt Lake City’s most dangerous roads.
Types of Car Accident Cases We Handle
We represent people injured in every kind of collision, including rear-end crashes, head-on collisions, T-bone (side-impact) accidents, hit-and-runs, multi-vehicle pileups, drunk and distracted driving crashes, uninsured and underinsured motorist claims, and rideshare (Uber and Lyft) accidents. No matter how the crash happened, we can tell you where you stand — for free.
Common Car Accident Injuries
The value of your claim is tied to how the crash affected your life. We handle cases involving whiplash and soft-tissue injuries, broken bones, herniated discs and back injuries, traumatic brain injuries and concussions, spinal cord damage, internal injuries, and permanent scarring or disfigurement. Even injuries that seem minor at first can require months of treatment — which is exactly why you shouldn't settle before you know the full picture.
Compensation You Can Recover
A full recovery accounts for everything the crash cost you — past, present, and future:
- Economic damages: medical bills, future medical care, lost wages, lost earning capacity, and property damage.
- Non-economic damages: pain and suffering, emotional distress, and loss of enjoyment of life.
- Punitive damages: in rare cases involving especially reckless conduct, such as a drunk driver, to punish and deter.
Insurance companies are quick to pay for a dented bumper and slow to pay for the human cost. We make sure the human cost is on the table.
How Insurance Companies Try to Pay You Less
Adjusters have a playbook: get you talking on a recorded line, offer a fast settlement before you've healed, argue your injuries were "pre-existing," blame you for part of the crash, and delay until you're desperate enough to take less. We've seen every move. We handle all communication with the insurer, document your injuries thoroughly, and hold them to the real value of your claim — and we're ready to file suit if they won't deal fairly.

Utah Injury Guide
What to Do After a Car Accident in Utah
Five steps to protect your health — and your claim.
Call 911 & Report It
Get police and medical help to the scene. The police report is key evidence — ask how to get a copy.
Document Everything
Photograph the vehicles, your injuries, and the scene. Get the other driver's information and any witness contacts.
See a Doctor Right Away
Even if you feel fine — some injuries surface days later. Prompt care protects your health and ties your injuries to the crash.
Don't Talk to the Insurer
Never give a recorded statement or accept a quick settlement offer before speaking with an attorney.
Call West Injury Law
Your own PIP pays first under Utah's no-fault law. Once medical bills pass $3,000 or an injury is permanent, you can pursue the at-fault driver — free consultation, no attorney fees unless we win.

Frequently Asked Questions
Do I have a case if the insurance company already offered me money?
Often, yes — and a fast offer is usually a sign your claim is worth more than they're admitting. Before you accept anything, let us review it for free. Once you sign a release, you can't reopen the claim.
How much does a car accident lawyer cost?
Nothing up front. We work on contingency, which means our fee comes out of the recovery we win for you. You pay nothing up front, and no attorney fees unless we win.
What if the accident was partly my fault?
You may still recover. Utah reduces your compensation by your share of fault, and you're barred only if you're 50% or more responsible. Insurers exaggerate your fault on purpose — we push back.
What if the other driver had no insurance?
You may be able to recover through your own uninsured/underinsured motorist coverage. We'll review your policy and find every source of recovery available to you.
How long do I have to file a claim in Utah?
Generally four years from the date of the crash for a personal injury claim, and two years for wrongful death — but evidence disappears fast, so it's best to call early.
Do I have to go to court?
Most cases settle without trial. But we prepare every case as if it will go to court, because insurers pay fairly when they know you're ready to.
